USA, California, Tustin – July 14, 2010 – Operating under unusual southern California shadows, actually some rather nice upscale residential townhomes adjacent Orange County’s former U.S. Marine Corps Helicopter Station, secret teams and squads of U.S. government federal agents task undercover assignments brought from other federal agencies.

One case, few ( if any ) federal agents wish to discuss, sees secret efforts naming the U.S. Federal Reserve ( FED ), U.S. Department of Homeland Security ( DHS ), Immigration Customs Enforcement, U.S. Central Intelligence Agency ( CIA ) along with a small group of operatives ( men and women ) combating international bank paper fraud worldwide, but strangely not so much the counterfeit manufacturing and / or distribution.

“During tough economic times we’re seeing more and more legitimate international businessmen involving themselves in trade financing deals not likely to have been consumated a few years ago,” said one agent who asked not to be identified.

The government enjoys public opinion that it somehow sees all and knows all in order to protect and provide a service so, ascertaining what a U.S. federal law enforcement agent is specifically interested in ( specific information ) is difficult for most interviewers to discover, but there was no pretentious air about this federal agent who at ease described in-general what his team encounters.

“When there’s a more than likely chance big money is going to be exchanged, we’re going to try and prevent that, but getting to the bottom of the problem is not easy. We’re not interested in wasting budget resources chasing around the world after foreign nationals, rogues or phantoms whom for the most part are behind international bank paper document artwork ( ‘counterfeiting’ ) or passing it around ( ‘distribution’ ) to see if any of it sticks and makes them some money in return.”

The agent continued, “Transaction handlers ( brokers ) or export managers typically inform us who they ‘think’ they’ve been working with, however the real nuts and bolts behind these global criminal organizations ( ringleaders / kingpins ) are now using so many multiple aliases and so frequently that it’s becoming difficult to keep track of who is really running what, where.”

When asked about something real interesting in a case he replied, “Well, at the top of our list is one we nicknamed ‘Philippines Phantom’ whose involved in an awful lot of international bank paper fraud schemes and he uses many aliases. We believe the Philippines Phantom has a close following of other nefarious characters using ‘his’ former aliases. At first we thought it was just other international bank paper crooks, further down the foodchain, just paying hommage to a bolder more famous crook, but then we realized the other crooks were simply too lazy and using the ‘Philippines Phantom’ alias gave them less work to do in pulling off an international bank paper fraud deal of their own.”

Who is the ‘Philippines Phantom’? When asked, no hints were given. The agent coughed and said, “That investigation is still ongoing so, no information at this time can be publicly released.”

Although no official information was released as to who the ‘Philippines Phantom’ really is, the agent suddenly asked if my laptop was online, it was and so the agent curiously visited a couple ( 2 ) foreign country websites. At each, he would go to a particular webpage, stand up from the chair and ask me if he could walk around the room and study the wallpaper. Now, I took that to indirectly indicate the agent wouldn’t be studying the webpages he was visiting ( in-private, the laptop was turned away from me ) so, I decidely took that curious opportunity to look at each webpage – long enough to copy each pertinent URL address for later review. Those two ( 2 ) webpages, UNWANTED PUBLICITY INFORMATION GROUP database files ( 16,000,000,000 pages and still growing ) and some global intelligence contacts gave my research enough information to fill this report and more.

Bank Paper Trade Tricks

Where imposters might not work as perfectly as very knowledgeable international master bank paper fraudsters, it has become easier with technology today to continue defrauding by simply changing appearances.

Fraud tricks, such as very short hair cuts ( or bald ), moustache or beard ( trimmed, cut off or added ), hair wigs ( different colors or styles ), weight loss or gain ( stuffed undergarments ), contact lens eyewear ( change eye colors ), identity papers ( different identity cards, passports, etc. ) are sometimes still used.
Smart fraud money is found where master bank paper fraudsters send-in entirely ‘new faces’ as their new ‘representatives’ whom may and are likelier now than ever before to be nothing more than unsuspecting freelance commissioned promoters acting unsuspectingly as the ‘middle-man’ or ‘broker’ for the master bank paper fraudsters whom are now disguising themselves to new unsuspecting “representatives” whom sometimes even come with respectable backgrounds. During tough economic times, a host of professionals are looking for work outside their usual occupations, and international bank paper fraudsters knowing this see tough economic times as their playground to further their own frauds and bottomline.

Modifying fraud techniques using computer enhancements can further bank paper frauds by the fraudster going one step further in obtaining and implimenting ‘security paper’ enhancing quality in the manufacturing of counterfeit bank paper and support documents for seemingly increased authenticity. The Philippines Phantom use of alaises, said to have been later reused by yet another host of other nefarious individuals, indicates ‘organized crime’ sophistication exercising indirect criminal subterfuge, tradecrafts used more likely by an international spy or international criminal mastermind, but in either event requires a special set of skills, excellent training and / or years of practice.

This particular case appears to have become operationalized not by a rogue spy but perhaps by a terrorist akin to the clever but infamous Carlos Illyich Ramirez-Sanchez (aka) Carlos The Jackal believed skilled in intelligence tradecrafts and used by the legacy Soviet Union KGB. More has definitely been seen out of the Philippines Phantom than most run of the mill international bank paper fraudsters and identity thieves. To remain aloof for so many decades without being caught by law enforcement whom are supposedly chasing international Asian terrorists speaks volumes as to the liklihood of another driving force that has ‘been allowing’ the Philippines Phantom to mysteriously escape punishment as was seen in 2001 ( further below ).

During October 2008, in California for his meeeting with NOC agent Neil Gibson at the Los Angeles International Airport, the Filipino man arrived from the Philippines to just drop off a few samples and – he ‘thought’ – collect his U.S. Federal Reserve Bank reward. Instead, the Filipino was told a lie by Neil B. Gibson that the U.S. Department of Homeland Security ( DHS ) had to clear his reward money through channels but that the Filipino man would get his reward.

Although the Filipino man, who never gave up was nicknamed “cowboy,” he was not deported and did not receive his so-called “reward” money as Neil Gibson described, but instead was flown back to the Philippines to secure more Series 1934 U.S. Federal Reserve Notes ( FRN ) from his contact for the U.S. government. Cowboy, was a southern California traveling businessman, an international “trader,” who commuted frequently to the Philippines, France, Ukraine, and around the rest of the world as required.
Some old timers believe it got so hot during the Cold War that nations were tripping over their own spies. Today perhaps, nothing’s changed except that valuable spies are not used out front in so many exchange deals as before but instead saw non-official cover ( NOC ) government foreign intelligence agents handle the brunt of that work because they are so much cheaper to maintain and easier to plausibly deny the existence of should secret government foreign operations go awry – as often times they do.

Fifth ( 5th ) Arrest In Bond Scam, Gang On The Run - Payab Explains His Role In Police Sting

THAILAND, Bangkok – A fifth ( 5th ) person [ William Morales ] has been arrested and charged with the multi-billion dollar U.S. bond fraud while other gang members are believed on the run but still in Thailand. A special law enforcement task force was formed to capture them.
William Morales, a Filipino, was taken into custody on Thursday night at the Town In Town Hotel located on Rama IX Road ( Bangkok, Thailand ).
Four ( 4 ) others were arrested earlier on Thursday:
Jacqueline Enriquez ( 29 ) – PHILIPPINES;
Robert Ng ( 43 ) – PHILIPPINES;
Tan Ho Chee ( 40 ) – SINGAPORE; and,
Chai-aree Santiwongchai ( son of a local Chinese language newspaper tycoon ).
They were charged with fraud and falsification after allegedly trying to sell fake United States bonds – dated 1934 – with a face value of $24,700,000,000 ( USD ) billion.
Chai-aree Santiwongchai was additionally charged after a lawyer for a leasing company complained he had issued a bad check for 4,500,000 million baht to his client.
The counterfeit bonds were brought into the country 7-months ago and put in a deposit box at DEUTSCHE BANK ( Bangkok, Thailand ) in the name of Mr. Chai-aree SantiWongChai.
Payab Shinawatra, brother of the Thailand Prime Minister, said yesterday he had been asked by a friend who believed the bonds were authentic to seek his brother’s help to redeem them in the United States. ‘The friend who approached him’ was ‘not among the five ( 5 ) arrested suspects’, and had ‘helped arrange’ for ‘him to meet’ the people who had the bonds.
Mr. Payab Shinawatra said he informed the Prime Minister he had been approached, and later contacted crime suppression police, who began an investigation.
The sellers had changed their mind on seeing him, prompting him to inform the police.
Police searched the house of Chai-aree Santiwongchai in Lat Phrao soi 1 for a second ( 2nd ) time Thursday night and said they found more bonds, believed to be counterfeit, pictures and related documents stuffed in a steel box bearing the U.S. seal.
Deputy National Police Chief Pol Gen Sant Sarutanont said task force members would be sent to Provinces where the remaining gang members are believed to be still in hiding.
About 3-years ago some foreigners arrived in Thailand using Thai citizens as intermediaries to attempt selling ( to gullible people ) fake U.S. bonds by claiming they ‘legally inherited’ them. Prospective victims were shown a document purporting to be a Court Order confirming that the sellers could execute sale of those U.S. bonds.
Deputy National Police Chief Pol Gen Sant Sarutanont said, “On April 10, 2001 the gang tried to sell 70 bonds – each valued at $10,000,000 ( USD ) million – to a Thailand customer who sent him pictures of the bonds. The U.S. American Embassy ( Bangkok, Thailand ) declared them fakes.
Police are still investigating whether the gang had anything to do with the U.S. bonds Senator Chaowarin Latthasaksiri claimed to have recovered from Lijia cave in Kanchanaburi. Senator Chaowarin Latthasaksiri said they were part of a treasure left by Japan troops during World War II.

Police Quandary Over Charges
Bonds Not Issued, So Fakes Not Counterfeit

THAILAND, Bangkok – The investigation into the counterfeit U.S. bonds case took a bizarre twist yesterday when investigators conceded they might not be able to take legal action against any of the five suspects they have arrested.

Bangkok police Crime Suppression Division ( CSD ) sources said the five ( 5 ), who have been under police detention since late last month, have been charged with forgery and fraud.
The sources said a ‘legal technicality prevents police from proceeding with the case’.
Investigators were unable to define the bonds, carrying the face value of $24,700,000,000 ( USD ) billion, as a counterfeit product. U.S. officials who were questioned as witnesses had told the CSD the U.S. government ‘had never printed bonds of that type’, which by legal interpretation, meant the documents ‘could not be considered forged’. “This means that we cannot charge them with forgery because they did not do anything which is considered an offence,” one of the sources said. He said the investigators had also charged the five ( 5 ) suspects with public fraud, but this could not proceed either since ‘no damaged party had lodged a complaint against the suspects’. “There are concerns among the officers involved that they could be sued by the five ( 5 ) suspects if they cannot find legal justifications for the arrest.”
William Morales, Jacqueline Enriquez ( 29 ) and Robert Ng ( 43 ) of the Philippines, and Tan Ho Chee ( 40 ) of Singapore and Chai-aree Santiwongchai ( son of a local Chinese-language newspaper tycoon ) were arrested late last month in a sting operation after it was alleged they possessed fake U.S. bonds.
The arrests came in the wake of a claim by Ratchaburi senator Chaowarin Latthasaksiri that a fortune in U.S. bonds was among treasure left inside a cave in Kanchanaburi province by Japan troops after World War II. It later turned out to be a hoax.
The five ( 5 ) suspects are being detained at the Bangkok Special Prison pending the outcome of the investigation.
The CSD will need the public prosecution endorsement if the five ( 5 ) are to be tried in court.

Japanese, Vietnamese Alleged Terrorists Charged

PHILIPPINES, Manila – Philippine immigration and police authorities filed criminal charges Monday against a Japanese man and two ( 2 ) Vietnamese men in connection with an alleged plan to bomb the Viet Nam Embassy in Manila.

Makoto Ito and the two ( 2 ) Vietnamese men – Vo Van Duc (aka) Nguyen Vinh Tan ( 41 ), a Vietnamese U.S. citizen, and Huyn Thuan Ngoc ( 42 ), a Vietnamese Switzerland citizen – were charged with violating immigration laws and illegal possession of explosives.

Immigration Commissioner Andrea Domingo told reporters that aside from overstaying in the Philippines, the three ( 3 ) alleged terrorists were also charged for the non-bailable offense of trying to overthrow an established government ( Viet Nam ).
Another suspect, Florinda Estrada-Valderama, a Filipina who allegedly owns the townhouse in San Juan, Manila Metro where the three ( 3 ) suspects were arrested Thursday, has been summoned for police questioning.
Officials indicate that the two ( 2 ) Vietnamese suspects are members of the GOVERNMENT OF FREE VIET NAM ( GFVN ), the political action arm of the militarized underground FREE VIETNAM REVOLUTIONARY GROUP ( FVRG ), that aims to free Viet Nam from communist rule military action .
Japanese suspect Makoto Ito ( 62 ) declared his innocence telling Japan media he, was a retired hotel employee seeking financial ventures in Manila, had met the two ( 2 ) other Vietnamese suspects through another acquaintance – Vietnamese U.S. citizen “Tony” – and was sharing an accommodation with them to save on rent.

Makoto Ito said that just like him, his acquaintance [ Tony Nguyen ] was seeking financial opportunities in the Philippines, and that he [ Tony Nguyen ] even showed him [ Makoto Ito ] a photo – of himself [ Tony Nguyen ] standing with former United States of America President William J. Clinton – amongst other photos presented during the press conference.
Makoto Ito – whom immigration and police surveillance showed was with the two ( 2 ) Vietnamese in three ( 3 ) houses they occupied in Metro Manila – is believed to be a financier of the group. Ito said he had been doing a survey for a subway project and researching on possible investment opportunities in a gyro-plane assembly plant when he was arrested along with the other two ( 2 ) suspects. “I’m a former hotel employee. I’m not a terrorist. It’s a mistaken arrest,” Ito told Japan reporters in an interview.
Earlier Monday, Makoto Ito wept and cowered from cameras when he and the two ( 2 ) Vietnamese men were presented before a press conference at Philippine National Police headquarters. Bomb materials, computers, books, and photos seized from the three ( 3 ) houses occupied by the suspects were also put on display to the media.
The GOVERNMENT OF FREE VIET NAM ( USA ) leader, Nguyen Huu Chanh, is believed to be in hiding and the subject of a manhunt in the Philippines.
In a FAX statement obtained by police, Nguyen H. Chanh admitted the Philippines arrested two ( 2 ) Vietnamese members of the GOVERNMENT OF FREE VIET NAM ( GFVN ) but said the GOVERNMENT OF FREE VIET NAM ( GFVN ) is not a terrorist organization and has no affiliation with the FREE VIETNAM REVOLUTIONARY GROUP ( FVRG ). The statement further read that the GOVERNMENT OF FREE VIET NAM ( GFVN ) is a worldwide organization engaged in liberating Vietnam from communist rule “by any possible means which are NOT against humanity,” and went on to say, “GFVN is NOT a terrorist organization. We have never been intended, and never will, [ edited-out by Philippines newspaper ] carry out any terrorist acts,” adding that the alleged explosive devices – seized from houses occupied by the three ( 3 ) suspects – “are our technical material which have been used solely in research for possible upcoming operations in Viet Nam.”

Whisper, he does travel occasionally. I met him some years ago in Bangkok. At the time he had some of the “Infamous” Soekarno and Marcos GB Certificates.

At the time he was actively involved with Tony Nyugen ( General Secretary of the Government of Free Viet Nam ) and Fred Kirkpatrick, a so-called 5 star General and former Senator from Illinois ( more lies ).
Their stated objectives was to use the Certificates to raise funds for the Government of Free Viet Nam. Tony Nyugen claimed he was going to be the next PM of Vietnam once they had freed Vietnam from Communism. Tony Nyugen’s organisation operates out of California and is still sctive.
Also involved was Gary Pierce – possibly “Pearce” – (aka) Gary Poindexter and Cheryl Poindexter of C.S.I. AG, a company that claimed to hold billions of gold reserves in Chile.

They issued Government of Free Vietnam Gold Bullion Reserve Certificates and sold many of them in the Far East. Of course, try to call on them at due date and what have you got, NOTHING. Even the officers have disappeared from the addresses given.

The whole group of these people also printed their own Government of Free Viet Nam currency ( money ) and was selling it to niave Vietnamese on the basis that when they come to power in Vietnam, the money would be full legal tender and they could then claim or use it.
All a very big SCAM with very devious people / parties behind it.
Ray Dam talks well and certainly has education, which is more than I can say for all the others, however WHAT A CROCK.
I just wasted a bit of time. I did not become involved…..fortunately.

A new "law process" is making the rounds. It is known as Commercial Redemption, hereinafter referred to as "CR." If you read "patriot" literature, surf the Internet, or belong to a militia or jural society, then you very likely have heard about it. I have read its praises, read the manuals, and sat through at least fifteen hours of seminars. Just as the Holy Scriptures admonish us to post warnings near an open-pit, I have written this report to explain why I believe that CR is a fraud and a trap. Anyone who does not agree with my conclusions is welcome to please offer constructive criticism, provided he has the courtesy to first read this report carefully, all the way through.

Before I proceed with the body of this report, I need to lay some groundwork. It is very important in conveying ideas, that everyone speak the same language. The following definitions are my own, you won't find them just as you see them here, in any dictionary. Using numerous dictionaries, and through my studies and prayers, I have distilled them into their underlying meanings, as I see them:

Abandoned: Any thing to which no one will claim a right.

Acceptance: An oath, whereby one agrees to take on a duty or a right. One may only accept a right if entitled to it by agreement.

Agency: A contractual relationship between two or more parties, where some parties, the agents, are given authority by other parties, the principals, to act on the principals' behalf. The scope of authority granted is limited by the terms of the contract, and further limited by the rights of the principal. No agent may ever exercise authority in excess of the rights of his principal.

Certificate: An oath, professing that a statement is true.

Claim: An oath, professing that a duty is owed, usually by a party other than the one making the claim. Claims set the basis for a controversy, without which, law-forums normally cannot secure jurisdiction.

Commerce: The exchange of oaths.

Common Law: A body of oaths which are common between a specific group of people. Within any specific group, those oaths can be said to be public law. From the perspective of anyone outside a given group, the oaths of the group would be private law.

Duty: An action which a man has given his oath to do. The exercise of law.

Escheat: The right of a finder to any thing which is otherwise abandoned. The converse right of due-process demands that anyone to whom the right might belong must first be given fair-notice and opportunity to exercise his claim.

Jurisdiction: Literally, "to speak one's law." Every man begins his life with the inherent right (free-agency is from God) to make his own oaths, or to not make them. When one man assigns to another his own right to bind himself in an oath, thus allowing the second man's word to obligate the first, then the first man has granted jurisdiction, and the second has assumed it.

Law: Oath; contract; agreement; covenant; promise; as distinguished from "laws of nature," such as gravity, which are not laws, but are "facts." Law can only be made by a "meeting of the minds" between sentient beings.

Person: Any party to a given body of law. A man may be a person under one body of law but, not having given certain oaths, not be a person under another.

Registration: The act of making a record for the purpose of giving notice of a particular fact or intention to one or more parties, and granting jurisdiction to the law-forum which holds the record to decide any disputes which may arise from the subject of said registration.

Right: A power received by way of an oath, and dependent upon the terms of said oath. Breach-of-contract (failure to perform a duty) will often divest a man of any rights he may have under that contract, but may not relieve him of his duties. A man may have rights in common with others, but his own rights are to the exclusion of others. A man's rights are his property. If you cannot identify the specific contract whereby you came into the possession of a right, and the duties which you must fulfill to continue your enjoyment of that right, then you probably do not have that right at all.

Surety: An oath, promising to fulfill an obligation in the event of a damage, injury, or breach-of-contract. Also a person who has given an oath of surety.

Title: From entitlement. Evidence of a right.

You're probably not accustomed to thinking of some of these words quite in the way I've defined them. I hope that I have made their meanings much easier to understand than before. Please keep them in mind as you read the balance of this report.
Commercial Redemption in a Nutshell

I do not claim to thoroughly comprehend the complexities of CR, but I'll now attempt to explain the basics so far as I know them.

The underlying idea behind CR is that you, and nearly everyone in America, became the property of the United States and/or the "International Bankers" when your mother signed your Birth-Certificate. Then, so the story goes, those BCs are traded in commerce, and are the real basis of the American economy. Since the U.S. has no authority to own people, it instead creates a fictitious person for each one of us, and gives it a name just like ours, except spelled with all capitalized letters. This person is called a "straw-man."

The U.S. then makes and enforces various decrees, which it calls laws, and which effect all the straw-men which it created. It can do this because the laws of agency say that the creator always controls its creations. The decrees don't actually obligate the flesh-and-blood man, but since (almost) everyone is deceived into believing that the straw-man and the real-man are one and the same, no one objects. When the I.R.S. or the traffic-cop, or some other U.S.-agent somehow obligate you for a debt, the debt is not really yours, but your straw-man's. Since you are presumed to be surety for the straw-man, you are held accountable when he fails to act. When you argue with the other party in the presence of the judge, you immediately grant the judge jurisdiction, and admit that there is a controversy, thereby giving the judge the authority to make an oath and obligate you to it.

The CR solution then, is thought to be in immediately agreeing with the opposing party, by "accepting his complaint for value," and denying the existence of a controversy. No controversy, no jurisdiction. "But wait," you say, "if you accept the charge, then don't you have to pay?" No.

As the CR story goes, there's something you have to do first, to make sure you'll never have to pay. You see, this straw-man has an account with the U.S. Treasury. The account is identified by the number which you usually think of as an "SSN." This account has lots of "bucks" in it, and also somehow represents the value of your body and soul. No one I've talked to is sure how much is in each account, but I'm told that it is up to each of us to decide how much we are worth (lots of sly-smiles and winks). In my experience, those people who have the least to show for their accomplishments place the highest value on themselves.

Presumably, we can gain control over this account, or "capture the straw-man" as the lingo goes, by getting a certified-copy of his birth-certificate, and accepting it for value. Then we claim to be his first-secured creditor, and register our claim with the Secretary-of-State for one of the United States, under a body of decrees, or private, copyrighted law, which they call the "Uniform Commercial Code." This part relies on the old patriot-style argument that there are two sides to the government, the "public-side," and the "private-side." It is important, so I'm told, to register on the "public" side of the U.C.C., or the procedure won't work.

Now that you control the account, if you accept any charge "for value," then you simply instruct the charging-party to charge your account with the U.S. Treasury. Since you can presumably place any value you like on that account, you will never have to pay for anything again!
What's Wrong with this Picture?

I'll be the first to admit that the above description of the CR process is overly-simplified. But it is also substantially accurate, so far as I comprehend it. Although I will concede that it is marginally possible that CR is a valid process, the following questions and answers may bring out some important contradictions:

Regarding the birth-certificate:
Q: I thought slavery was illegal. Can governments or bankers really own people?
A: Yes. Only involuntary slavery is prohibited by the U.S. corporate charter. That same charter (Constitution) also protects private-contracts.
Q: If our mothers really signed us over to someone else at birth, then why does that someone need a straw-man? If someone holds title to you and me, then why not just produce it, and end the charade?
A: Because the charade, not whether you are actually owned by someone else is the most important point. Your rulers know that if they are to continue to rule you, it is necessary that you must continue to believe either that:
Your fate as a slave is inevitable, and you have no hope; or
If you study hard enough you will one day be delivered of all tyranny, if only you can find just the right paperwork.
Either way, they have you in their grasp.
Q: What is a birth-certificate?
A: Look, for example, at the "certificate of title" for a car. It is not a title, it just certifies that a title does exist. Since the certifier is an officer of a U.S. law-forum, that law-forum will accept the certificate as evidence of title, in the absence of the real title. Think: if the birth-certificate is a title, then why is it called a certificate? The mother almost-never signs the birth-certificate, and then, only as a witness.
Q: Then isn't a certified-copy of a certificate, just someone's promise that somebody else promised that something is true?
A: Yes.
Q: If I obtain a certified-copy of a certificate, and then burn, staple, accept-for-value, or otherwise mutilate it, will that stop the very same person from making the very same certification again?
A: No.
Q: Is it possible for me to ever get my original birth-certificate back?
A: While anything is technically possible, the real answer is no. The explanation is in two parts:
If the clerk has the document: When a clerk is elected or appointed, he gives an oath to do his job, which includes sealing all incoming documents with the Seal of his Office, and marking them with an identifier of some kind so they can be indexed and found again. Some instruments he files, which means that he keeps the originals, and some he only records, which means he makes a copy, and returns the original to its rightful-owner. Then it is his duty to protect those records from ever disappearing. If he ever allows a document to be taken from his trust, he is in deep doo-doo.
If the clerk doesn't have the document: If you ever find out who does have your original birth-certificate, he is most likely going to be someone of free-character, who owns or controls the law-forum represented by the clerk. The court itself, the U.S. law-forum, is a debter to this person. An employee cannot compel his employer/creator to do anything. No one with a position within that law-forum, not even their highest judge, will have standing to compel him.
Q: I insist on living in fantasy-land, so please indulge me a "what-if." If I do ever get my original birth-certificate back from whoever has it, will that cancel the title held by whoever might own me?
A: No. A certificate may be used as evidence of title, but is not the highest-evidence, which is the actual title. Anyone who has firsthand knowledge of facts can certify to those facts, and they can do it as many times as they please. If you get the "original-certificate" back, there is nothing to stop the same person who signed your certificate from signing another one. And, at any time the holder of the actual-title appears, the existence of a certificate is mute anyway.
Q: Does a certificate even really have to be true?
A: No, but the certifying-person can be held accountable for making a false-oath. The burden of proof is on the accuser, not the certifying-person.
Q: If the birth-certificate is only "evidence" of title, and not the actual title, then what is the actual title?
A: First, remember that we don't know for sure that anyone actually has a title to our bodies; the idea is merely a widely accepted theory. Just because it has been repeated many times, does not necessarily make it true. That said, it is probable, if there is a title, that it would be something else that your mother might she have signed, such as a "Statement of Live Birth," or the "Application for Birth-Certificate. The main point is that if you're going to spend a lot of time trying to track down the existence of a title, then at least go after the correct instrument.
Q: When other types of titles, such as land-deeds, mortgages, liens, etc., are canceled or transferred to someone else, how is that done?
A: With another instrument. If the parties want a particular law-forum to take "cognizance," which means to assume jurisdiction over the cancellation or transfer, then they will register it with the clerk for that law-forum. When a canceling instrument appears in the same law-forum's records in which the original document appears, it is said to "lay on top" of the original, and the law-forum takes cognizance that the original is now without effect.
Q: Do you know of any instance where someone's birth-certificate, or the underlying actual-title, was effectively canceled or terminated?
A: Yes. This is done many-thousands of times each day, with an instrument known as a death-certificate.

Regarding the Straw-Man:
Q: If a straw-man exists, even in peoples' minds or on paper, and if the relationship between the real-man and the straw-man is based on deception, then isn't accepting the straw-man "for value" the same as agreeing to continue a lie, and to be obligated to that lie?
A: Congratulations, you answered that one for yourself.
Q: If the straw-man is a fiction, doesn't that mean he isn't real? If he isn't real, doesn't that mean that he doesn't exist? Then why are we talking about a straw-man?
A: Yes. Yes. For the same reason that the news-media reports stories of little or no significance, just to keep you confused, it is so very-very important to your masters that you never figure out the real answers.

Regarding Claims:
Q: If I claim to own or control something, does that make it true?
A: No. You, just like anyone else, might lie or be mistaken. Remember, a claim is a statement that someone has a duty. When you claim to own something, you are stating that everyone else has a duty to leave you alone in the exclusive peaceful enjoyment of that certain something. A claim can sometimes create the presumption of a right, if unchallenged, but more often it just creates the basis for a controversy. The burden of proof is on the disputing-party, which might be a point in favor of CR, if there is no other titleholder, or if the true titleholder is unwilling or unable to produce evidence of title.
Q: What is the purpose of registering my claim with the Secretary of State, under the U.C.C.?
A: The only purpose for registering anything with a given law-forum is to grant jurisdiction to that law-forum. In doing the above, you are saying "I have made a claim. If anyone disputes my claim, then the law-forum in which I have registered it has the jurisdiction to decide who has the higher claim. Please use the U.C.C. as the common-law upon which to base your decision. I have voluntarily waived any objection to the probable fact that the only likely adverse claimant is the same person who created and, therefore controls this law-forum." If you examine this statement carefully you will understand that if the adverse claimant does control the court, then your waiver-by-registration gives the court permission to take silent judicial notice that you have no standing; have failed to state a claim upon which relief can be granted; and dismiss the case without even the obligation of explaining why. This drawback more-than negates any possible advantage gained from paragraph "A" above.
Q: But what if I'm careful to register with the "public side" of the U.C.C.?
A: The U.C.C. is a body of law, not a law-forum. It cannot make decisions, it is only a set of rules which can be used by a law-forum to help in the decision-making process. Please reread my definitions of "common-law," and "registration." Prior to registering your claim you may or may not be contractually obligated to observe the U.C.C. If you are not, then to you it is foreign private-law. Upon registering your claim with a clerk for a U.S. law-forum, it is now under their jurisdiction, and the U.C.C. is your public-law. Congratulations, you've successfully registered your U.C.C.-1 on the public side!

Regarding Acceptance:
Q: Can I accept someone else's right, without their consent, and make it mine?
A: No. Therefore, your "acceptance" is merely a claim. You can claim any right you want, but that doesn't mean it's really yours. If I accept your car for value, is it now mine? Of course not. Before you can accept a thing from someone, they must first offer it.
Q: When someone charges me with something, is he making me an offer, and if so, what is he offering?
A: If you damage or injure someone, or breach the terms of a contract in which you are a party, and someone charges you for that, he is making a claim, stating that you have a duty to make restitution, and he has a right to be restored. He is offering you the opportunity to demonstrate whether you are an honorable man, or a lawless heathen. Honor means that you are collectable. If you are honorable, you have the duty to act honorably. All duties have corresponding rights. You now have either the right to accept the duty to restore the claimant, or the duty to dispute his claim of a right. If you fail to do either, you have left the claimant without a remedy; you are acting without law or honor, and have abandoned your right to "speak your law" (see the definitions for "jurisdiction," "abandoned," and "escheat."
Q: If I accept a duty, does that mean I am obligated to fulfill it?
A: Of course.
Q: What happens if I accept a charge "for value," instruct the charging-party to get payment from the U.S. Treasury, or any other third-party over whom I have no direct control, and then the third-party doesn't pay?
A: When you accept a duty, "for value" or otherwise, that duty becomes yours. The charging-party is not obligated to collect from a third-party, any more than you can obligate a third-party without their prior consent. The charging-party may or may not choose to even try to collect from the third-party, and unless you demonstrate to the charging-party a very strong contractual obligation on behalf of the third-party, he probably will not. In any case, once the duty has been accepted, restitution must be made. You accepted the duty, and you are now the ultimate surety for its satisfaction.
Q: If I decide to try CR and it blows up in my face, can I later claim that the straw-man doesn't really exist and, therefore, the obligation doesn't either?
A: Again, you can claim what you want, but that doesn't make it true. The straw-man isn't real, but you are. Once you've accepted a duty, the burden of proof shifts to you if for any reason you fail to perform.

Silver Bullets

It seems like a lifetime has passed since I became involved with the "patriot movement," as many people call it, though it has only been about seven years, and I no longer consider myself a patriot now that I know the meaning of the word, and its implications. Though I may not be an "old-timer" in the sense of years, I have studied much and worked hard. I've seen many new "processes" come and go, all of them thought to be the silver-bullet which would slay the beast called Tyranny. Some of them were ridiculous from the outset, though I didn't know it at the time. Some worked for a time, and later were defeated. A few are valid, and when used correctly will work sometimes, depending on how they are applied, and how vital the issue is to the adversary. But none is the proverbial "silver-bullet." That doesn't, and should not, stop us from trying. Hopefully we will learn from our mistakes.

My perspective of the world, based on my study of history, can be summed up briefly:

The greatest influence on society, since the beginning of time, has been man's desire and ability to inflict violence on his neighbors.

When man was a hunter-gatherer there was very little incentive for violence, since he could not easily save more food than he could acquire in a day. He moved around a lot, so material possessions were more of a hindrance than a benefit. An occasional squabble over a woman was pretty much the extent of conflicts. As man learned to farm, he became increasingly violent. Now he could produce much more in a day than he could eat, and he learned to store it for the future. If others came into the area and tried to take what he had worked for, he would fight. People learned to band together for protection, and also for conquest (theft). Most people did not want to concern themselves with protection on a daily basis, so they hired people who were more interested in violence, and paid them with their excess. Successful farmers could afford a lot of soldiers, and soon found that hiring those soldiers to steal the work of others was a lot less work than farming. Soldiers also often took matters into their own hands.

Thus have evolved governments. And so long as governments are not perceived by the people to steal too much, or to be excessively violent, most people will tolerate them in exchange for protection from outside conquest which they fear might be more severe. The only difference between a modern government and a mafia-style protection-racket, is its size and scope. For its authority, government does not rely upon law, but upon its perceived capacity to do violence in exchange for noncompliance.

Notice my reliance upon the word "perceived." The people who rule over large numbers of people are, by definition, outnumbered. They know that they could never win a battle where their own subjects were determined to defeat them. They must rely heavily upon the good-faith of the people, to maintain their position. If that good-faith ever waivers, governments will do anything necessary to reclaim it.

Those of us who have studied history and government know that we live everyday with a great deal of fraud, and we suspect that we are only aware of the tip of an iceberg. But we are a minority. Most people believe the Big-Lie. If enough fall away, then almost invariably a charismatic government-shepherd will appear to lead them back into the fold.

When I first began my study of law, I believed that if I could find just the right paperwork, and if I could draft it flawlessly, and use the correct procedure, then the government-agencies who were set upon stealing from me or controlling me would have to give up, and go away. I now see the folly of that belief. However, I have discovered that governments will always do the "right thing" in a situation where a large number of people are paying close attention. The trick is to wake people up and make them watch, and care.

We know how difficult it is to bring people around to our point of view. Governments have had an iron-fisted control over the education of our children for so long, that even stark reason is sometimes hard to get across to them. No matter what procedure we use to try and separate from Babylon, governments will try to resist letting us go. They will, no doubt, trump up charges in an attempt to demonize us, and turn the common man against us. If we use a procedure which is not understandable by the common man, then we make governments' job easy for them. If we find and use a procedure which is easily understandable, the common man will probably still not support us, but it will be much more difficult for governments to move him to actively prosecute us, or even to stand by idly while others do.

I have already stated that I do not fully comprehend the CR process, even though I have made much more effort to do so than most people, even "patriot-types," ever will. I am not a stupid man, and I think it is safe to assume that if I don't see the validity of CR now, then most people will never understand it. That means that even if CR is a valid process, it will never ultimately achieve its intended purpose.

Worse yet, the CR process involves commercial instruments which use the banking system and the U.S. Treasury. The last process we saw which used similar tactics was put forth by the Montana Freemen, and resulted in many of our own friends going to prison. I do not believe that their procedure was valid, but even if it was, they were not able to convince a jury. They were not able to turn public-opinion in their favor. Right or wrong, they were prosecuted. We expect persecution in our quest for freedom. Many of us are willing, if necessary, to go to prison for being right. But who wants to go to prison for being wrong?

I believe that the Commercial Redemption process is wrong. I also believe, for the reasons stated directly above, that even if someone can now prove to me that CR is valid, it is nevertheless still wrong. The only chance we have of ever finding a "silver-bullet," is in using a valid procedure which is understandable by the common man.

It is my prayer that the reader will carefully consider all of the above points, and accept them for value. In my next article I hope to present a procedure which I believe fulfills the requirements I have set forth above

Have we uncovered Foundation X leads to UNOITC

Have we uncovered “Foundation X”?

In the comments to the last post, Luke Waterfield has supplied a plausible solution to the identity of “Foundation X”, the mysterious and secretive organisation with unlimited funds that has held meetings with a Lord and a member of the British cabinet about investing in the UK.

Is “Foundation X” the “United Nations Office of International Treasury Control” a body which claims to be a “Sovereign Entity” formed after the end of the Second World War?

If you want to know more, they have a most informative video here. Iain M Banks fans will note a wry sense of science fiction humour in the choice of music.

Naturally, everybody linked to the actual United Nations denies any such body exists.

But as all conspiracy theorists know, that’s a dead giveaway. Plausible deniability is important.

The UNOITC is run by a Dr Ray C Dam. However, as the UNOITC website makes clear, “Dr. Ray C. Dam is a person, but His Excellency Dr. Ray C. Dam is a certified and indemnified international Central Banking financial institution operating as The Office of International Treasury Control.” So you’ve got to get the details right.

The similarities between “Foundation X” and “UNOITC” are notable.

“Foundation X” has Gold Bullion, and wants to invest in billions in economic reconstruction. So does the UNOITC. Additionally, there is mention of the gold standard in both accounts.

“Foundation X” is secretive and only wishes to discuss their proposals with extremely powerful people. The UNOITC has a similar sense of propriety, as can be seen by their unhappiness with the response they got from the Scottish Government when they offered help there.

But of course, it could be someone is trying to scam the UK government, in the disguise of the UNOITC, relying on the good name of that body for their own nefarious purposes (ahem). According to the UNOITC themselves, such unsavory business practices have been ongoing, and Governments must be watchful.

To be serious for a moment, UNOITC are a plausible candidate for “Foundation X”. According to their Wikipedia entry, they have a history of making similar approaches to governments like Fiji, and even attempted to buy MG Rover for the familiar sum of £5 billion.

This was a significant over-valuation, so it’s perhaps unsurprising that they did not prceed with that investment. Why do they seek to make such approaches? No-one knows.

If this is the case, it’s rather sad that Lord James has been taken in by a pretty blatant and rather silly hoax. Lord James is, I’m sure, a decent man, and we all make mistakes. It would be wrong to overly mock a man with a distinguished career for making such a mistake late in life.

What’s a little more disturbing is that this… misunderstanding, has led to representatives of this body gaining a meeting with a Cabinet minister and their proposal apparently leading to discussions with other ministers.

I don’t doubt that Lord James is telling the truth when he says he was contacted by an FSA regulated financial institution. But if it’s this body, I’m amazed that it wasn’t immediately spotted as a hoax. or at the very least, a joke of some sort.

So how did it get so high up in government?

Perhaps Lord Strathclyde was acting out of simple good manners, trying to be sympathetic to a colleague. That’s understandable. But to put yourself in a position where possible fraudsters get to meet with Cabinet Ministers is… unusual.

It’s certainly on a par with that Australian fellow with the dodgy diet tea company!

In any case, I wonder what discussions Ministers have had over the activities of the UNOITC, and if the Government needs to be slightly more on guard against the activities of what you might call, in another tribute to Iain M Banks, the “Finance Culture Eccentric”

The Keenan lawsuit and the phony UNOITC

As to the Keenan lawsuit mentioned I took it on, on GLP because everyone there thought it was going to free the world and its mostly about a greedy person who made some grave judgemental errors and wants his commisions back. I do have a copy of it. I had not chosen yet to publish it here but I spent a week rolling on the floor laughing and glad I wasn't in it, but Keenan had threatened me to be included if I didn't shut the fuck up. Needless to say, the OITC and Dave Sale are named defendents. -Candace

1. Contrary to what some people may believe, I can assure everyone that Mr Sale, others working with the OITC, and I are still free man and have not been arrested at any time over the last 18 months, nor paid any visit by the Police authorities of any country or Interpol, etc.

2. The so-called Law Suit issued by Neil Francis Keenan via the District Court of South New York:

· I say “So-called” because when I read it I realised what a joke the American legal system is and how pathetic a few greedy people are, being people who are only considering themselves and know very, very little of the subject matter, for which I make the following comments.

· The District Court of South New York is not a Court of competent jurisdiction in such matters.

· The District Court Judges are not Judges holding competent jurisdiction on such matters and would never be allowed to handle matters that are, either partly or wholly, covered under Official Secrets acts or covered under one of the highest International Security Classifications.

· The Lawsuit is actually and largely made up of, quote “Upon information and belief”. This is sheer conjecture and supposition by Keenan who has absolutely no knowledge whatsoever of what he speaks, only what he has been informed by a known and recorded Felon and others whose self interest is clearly visible.

· America holds no jurisdiction over such matters. This is a matter for the International Courts of Justice (ICJ) because of the Sovereign and Security issues being presented. Such a case within the ICJ is impossible because Keenan is not a Sovereign Nation or Sovereign Entity, so to summarise, this case will go nowhere and as such probably be used to indicate, wrongly I add, how the American courts are in the pockets of the illumine.

· If Keenan, or America, believe the Defendants are going to submit themselves to jurisdiction by a low level court in America, think again, because that will NEVER happen.

· To date, I am aware that some of the named defendants have not yet been officially served with notice of this Law Suit, and probably never will be because of their status. Therefore, this so-called Law Suit remains just a piece of paper of no effect and a propaganda tool.

· No doubt the Lawyer who prepared all of this is looking forward for a nice substantial payout from the proceeds of a successful court case. I believe he will more than likely end up receiving nothing and may be he will be “Pulled in” for questioning by the FBI, in relation to his involvement in such “Secret” matters.

· I see Keenan and AC/DC are now stating that there was no criminal court case in Italy regarding Yamaguchi and Watanabe, because they can not gain access to the court documents (Case records), so they are assuming that no documents means no case.

How foolish these people are to think the way they do and then try to mislead others into their way of thinking by making such statements about the court documents. That just portrays, perfectly, the mentality of the above people.

Funny how we actually have a complete set of the Italian court documents (Case records), for which I can state that because of the “Secrecy” factor surrounding the issue, the documents (Court records) were taken from the regular files and marked “Secret”, being filed away in different archives, with totally restricted access.

· Taking the above into account, people ought to start asking what the actual intent of these people is. Read and undertake an assessment of their words, phrases and sentences. Read between the lines and beneath such words, phrases and sentences, instead of just absorbing and believing what you see written on bits of paper instead of seriously analysing same. You’ll be surprised at the different picture you see.

· A group (Truthful Portal) issued a Video on Youtube (http://www.youtube.com/watch?v=0gUAGsM0gG4), castigating Scott and Keenan. Within that Video there are several panels one should take explicit note of because they are highly relevant.

· A panel at time sequence 07.39 evidencing an email written by Scott to Dr. R.C. Dam, which stated “We can all make serious money”. Typical Scott and without question shows what he is in this for and why he is, and always has done, working with the likes of these people

· Another panel at the time sequence 04.43 indicates that Keenan has been talking to several Finance Ministers including the Russian Finance Minister, Alexei Kudrin. Surprisingly, or not actually surprisingly, Alexei Kudrin was sacked as Finance Minister when it was known he attended a meeting and was discussing National Financial issues, without Government authorisation, with an unauthorised person. Now, the very same man is trying to form a Liberal Party in Russia. One could say ………Another Traitor bites the dust.

· Another panel at time sequence 08.02 in which Scott states “There is little you can do for us, but there is a lot we can do for you”. I would unreservedly place a “Mild Threat” factor against that statement made by Scott.

· Other panels with time sequence at 08.32 and onwards, should really make people ask as to why when Scott was working with Dr. R. C. Dam as Chief of the Cabinet, and R.C. Dam’s right hand man for 13 years, did he (Scott) allow such a situation to arise without immediately taking correction action. Either he was incapable of taking corrective action, or, as we inside the OITC already know, he (Scott) was working the other side of the fence and deliberately allowed R.C. Dam to make mistakes and dig a hole for himself………………Another Traitor of a Sovereign Entity.

· Another panel with time sequence 09.03 clearly indicates that Scott, Keenan are working to turn the whole situation around. Under whose authority is he doing this because he hasn’t worked for the OITC since he left hurriedly in March 2008 after being faced with possible arrest from being associated with “Brokers” who were attempting to used the Collateral Accounts unlawfully and without authority. The main “Broker” involved talked like a bird during interrogation, which included answers as to who benefited from the $130 million Dollars extorted from 2 countries as “Up Front Fees and Prepaid Commissions”. Not surprisingly, Scott’s name was very prominent.

· Another panel at time sequence 10.08 states “You could have been out ofCambodia with all your bills paid and problems solved and a HUGE LOAD OF MONEY six months ago”. Wow, is all that what matters to these people ….. HUGE LOADS OF MONEY …… seems like it and Scott and Keenan are right there in the front line waiting to fill their pockets.

I urge everyone to use common sense on this matter and face the real situation based upon fact.

Scott was known for his greed within the OITC whereby very few people trusted him or would even work with him. He actually recruited teams of “Brokers” to do his dirty work for him, passing them the information they needed to able them to do that work.

Keenan was, and still is, part of a crooked Japanese group which has its head as Akihiko Yamaguchi (a former felon serving 12 years of a 20 year prison sentence for fraud… 1984 – 1996). Yamaguchi, with a colleague Watanabe, HAVE been convicted in an Italian Court and sentenced in their absence to 3 ½ years imprisonment.

As far as I am concerned, leopards, even members of their family; do not change their spots.

There has also been a lot of criticism of David Sale, but I will tell you what, that man was requested to take over and did so with a lot of professionalism, holding the OITC together, and all the people under him, under very difficult circumstances, until such time as RCD returned or was replaced by the Hierarchy. If anyone criticises a person without knowing the whole truth, then those who criticise, ridicule, or blame, need to be totally curtailed and looked upon as agitators, activists, and to a point insurgents, with a total self interest.

That is all I will say on the matter for the moment, except that if you want to believe all the garbage people like Scott, Keenan, Fulford (the mouthpiece) and Wilcox (the naïve) put out, then you are no better than them as Financial Terrorists. The day will dawn when the truth will be seen whereby many people will end up kicking themselves for believing in such falsities.

Wallace, Idaho – Just when was it that the United Snakes of America declared war on the Coeur d'Alene Mining District, and why?

We were ruminating, fulminating on these weighty questions last week. Pretty clearly, the opening salvo was fired in the final decade of the 19th Century, when Federal troops were dispatched under a declaration of martial law to lock up 600 miners here who were striking for decent wages.

Then of course during World War II there was the undeclared conscription of lead and zinc miners here who were prevented from taking better paying jobs in the shipyards of Puget Sound to keep wresting rocks from our earth that could be smelted into bullets and cartridges to kill Germans and Japanese.

For that trouble, we were rewarded, in 1984, by being declared a federal Superfund site by the U.S. Environmental Protection Agency and we have been struggling under the EPA's yoke ever since – as have some 70 mining companies who produced bullet-makings for the government in the 1940s, most of them mom-and-pop operations. Or was it in 1991, when agents of the Federal Bureau of Investigation swooped down upon us, shutting down our card games and seizing our slot machines, in their assault on our laissez-faire way of life?

Was it just last year, when the US EPA sweated a $200 million settlement out of Hecla Mining Co. for alleged “environmental damages” for having the temerity to mine silver, lead and zinc in the Silver Valley? (That amount, ironically, is about what Hecla intends to spend extending the life of the Lucky Friday by some 30 years.)

Or was it just last week, when the federal Mine Safety and Health Administration shuttered the Lucky Friday mine for up to a year on an utterly vacuous claim that is main vertical access way, the Silver Shaft, had miraculously become unsafe – overnight? This is the same MSHA that inspects the shaft every three months, most recently a month ago. What changed in 30 days to render the Silver Shaft unserviceable? According to MSHA, 30 years' accumulation of crud leaking from sand lines that have built up along the mile-deep, 18-foot cylindrical shaft's concrete liner.

This is federal government arrogance at its height. It is brazen and it reeks of ass-covering. It is also ineptitude at its height, to the detriment of some 200 Hecla Mining Co. employees and a like number of Cementation Corp. contract workers who were at work sinking the new No. 4 Shaft internal winze. As of late last week, Hecla miners were barred by MSHA even from maintaining the critical pumps to keep water out of the lower workings of the Lucky Friday, where most of the machinery is. The 4 Shaft is collared on the 4,900-foot level and most of the current ore hauling was being done on the 5,900-level to the Silver Shaft.

Miners tell this reporter that scaling-off accumulations of sand-line leaks has been an ongoing maintenance procedure since the Silver Shaft – unique to a district where wood-lined, rectangular (and infinitely more maintenance-intensive) shafts are the norm – was commissioned in 1983. Hecla, treading lightly, says it doesn't consider the MSHA closure order politically motivated. We beg to differ. It is all about politics. In the wake of the April, 2011 death of drift-miner Pete Merek on the 5900-level, MSHA directed Hecla to re-route that heading into uncharted territory. Following MSHA's orders led to a pair of rock-bursts in November and December last year, the latter of which injured seven men.

Our friendly local miners figure that MSHA's order to close the Silver Shaft is directly connected to its mandated screw-ups on the 5900 – essentially to distract attention from the injuries the agency's order caused. Some early scuttlebutt that MSHA had been pestering Hecla to clean up the Silver Shaft likely is rumour-mongering by the federal agency. But MSHA doesn't pester: it writes citations, issues orders and demands fines; it doesn't give advice.

Years ago MSHA was staffed by inspectors who'd spent years underground breaking rock for a living. They knew the art of the possible and the practical, and could with considerable moral authority cite a company that was bending the rules to the detriment of safety. The new breed of cat is different: college boys with little or no experience in the reality of hard-rock mining. The hard-rock miners they are ostensibly there to protect hold their ineptitude and their rule-book rigidity in contempt.

So, 3.5 million ounces of silver production from the Lucky Friday will be held off the books of America's export balance sheet this year. Our silver consumption will continue at or above its current rate, so we'll have to import more silver, and print more paper dollars to pay for it – which just drives up the price of milk and gasoline for all of us and the 400-plus miners now on the bricks.

No doubt some Goldman-Sachs-style short-seller made off like a bandit when the MSHA order caused Hecla's stock to crater from $6 to nearly $4 in a day's trading last week. Given the cozy cronyism between Wall Street and the United Snakes Government these days, might we wonder if more than just politics were involved?

This wasn't a war that the hardy people of northern Idaho started, back in the 1890s, or the 1980s, the 1990s, or just last week. We'd rather be known as the culture that brought decent working conditions, women's suffrage, and other enlightenments to the nation's conscience. But it is a fight we need to finish, and finish decisively.

The US Treasury has published countless consumer alerts warning those who fall into the clutches of the debt elimination scam artists that instruments labeled Bills of Exchange, Due Bills, Redemption Certificates, and Bonds of Discharge are fraudulent since most of these instruments are used only in the international arena by government agencies, banks, or transnational corporations engaged in commerce with other nations, banks or transnational corporations. They are never used by consumers without money to escape lawful debt (particularly when, until lawful money actually changes hands, nothing happens—except those who try to perpetuate the fraud are charged with a felony for their efforts.) US Treasury alerts are intended to inform those who are told otherwise that even if such forms appear to look like legitimate documents, all of them are premised on fraudulent claims. They are worthless and have no legal validity. In addition, those who get caught up in the scam are guilty of violating 18 USC § 1345.

The Never ending MF Global Story: Regulators Block The Truth

Instead of looking out for MF Global investors – and customers who are still waiting for their money – it looks like regulators and the bankruptcy trustees are busy suppressing information. Instead of full transparency, regulators and the trustees are holding onto crucial details that might tell us all who was asleep at the wheel when the broker/dealer and futures commission merchant (FCM) headed over the cliff.

Bob English, an independent trader and contributing editor to the blog, Economic Policy Journal, published a post this morning that raises serious questions about the Securities and Exchange Commission’s program of regulation for broker/dealers and, in particular, the agency’s role in keeping the truth from the public about what went wrong at MF Global. We’re also being kept from the truth about other broker/dealers who may be putting risky trades on their books or whose controls over segregation of customer assets may be weak or non-existent.

It seems that sloppy scanning and filing standards combined with preferential treatment for certain large brokers have substantially reduced the value of this part of the SEC’s public filing system. Since this is often the sole repository for disclosures about private companies, including broker dealers that do not have public holding companies, investors are being deprived of timely and critical information.

Even for those broker dealers that do have public holding companies, such as MF Global Inc., the financial notes of the broker audits disclose different, and oftentimes, more substantial information. Since it is now apparent that Louis Freeh, the former FBI Director cum MF Global Holdings trustee, is running cover for MF’s largest creditors, not the least of which is JP Morgan Chase, it is all the more critical that the integrity of the SEC’s public filing system be scrutinized.

On November 4, 2011, days after the bankruptcy filing, I described in an American Banker column the information the regulators and investigators should be looking for:

Since MF Global is a broker-dealer and a Futures Commission Merchant, PwC’s job went well beyond a standard audit. The auditor for a firm like this must annually review the procedures for safeguarding customer and firm assets in accordance with the Commodity Exchange Act. The annual audit must include a review of a firm’s practices and procedures for computing the amounts that, by law, have to be set aside in clients’ accounts each day. MF Global also had to send regulators an annual supplemental report from PwC. This report would describe any material inadequacies existing since the date of the previous audit and any corrective action taken or proposed.

I’m sure the CFTC wants to know if PwC ever documented any material inadequacies in MF Global’s controls over safeguarding customer assets. But wouldn’t they already know that? Regulators like the CME Group, the CFTC, the SEC, and FINRA received audited financial information annually, unaudited information semiannually and monthly reports that provided a capsule view of MF Global’s financial position. MF Global is required to perform calculations daily (by the CFTC) and weekly (by the SEC) to ensure that the proper amount of customer funds is set aside in the separate accounts.

PwC’s report to the SEC of internal control discrepancies for 2010 – and there is one according to the filing index – is private. None of the auditor’s reports specific to the broker/dealer and FCM are available to the public on Edgar for 2011.

Is this just sloppy scanning? It’s no coincidence to me that auditor PricewaterhouseCoopers may also be playing a role in keeping uncomfortable or incriminating information from the public about its audit clients. PwC audits MF Global as well as Bank of America, Goldman Sachs, JP Morgan, and Barclays. (See latest record fine against PwC for looking the other way at customer funds commingling at JP Morgan. PwC is also under investigation for similar sins at Barclays.) The largest audit firms routinely request confidential treatment of their reports and contract details such as engagement partners, whether as a vendor to the government or as a defendant in a contentious lawsuit.

There’s also a very strong interest on all sides of the MF Global mess in not leading anyone to third-parties such as bankers like JP Morgan, lawyers, and PwC, the auditors, too soon. Is there something in PwC’s secret audit reports and internal controls discrepancy reports for the broker/dealer for 2010 and perhaps 2011, that someone, anyone should have paid attention to earlier?

Here we are, more than two months after the forced liquidation of the MF Global broker dealer - it’s important to note this was no voluntary bankruptcy filing but a liquidation forced on MF Global by the Securities Investor Protection Corp – and the missing $1.2 billion of customer funds has not yet shown up.

The customer assets are gone, but no one in the officialdom - the two bankruptcy trustees, the CFTC, the SEC, or the Department of Justice – wants to admit just yet that the bankruptcy estate and, therefore, the customers will come up short.

No one but the CME Group will say that out loud. The CME Group timeline of events, updated most recently as sworn testimony by Terry Duffy to Congress, is the only reliable timeline out there.

Shortly after the filing on October 31st, all parties, including MF Global’s General Counsel Laurie Ferber, admitted that customer funds were short, not just misplaced. We’ve seen no new “on the record” facts from investigators, trustees, or regulators to refute these dramatic admissions.

CFTC in bankruptcy filing October 31 according to The Financial Times: The CFTC, in a court filing, revealed MF Global’s general counsel Laurie Ferber emailed the regulator at 7.18pm Monday – hours after the bankruptcy filing – to say that it had “discovered a significant shortfall in its segregated funds account”.

Joint statement of CFTC and SEC on November 1: “Early this morning, MF Global informed the regulators that the transaction had not been agreed to and reported possible deficiencies in customer futures segregated accounts held at the firm.”

When the trustees, the regulators, and the FBI finally stop looking under sofa cushions for the missing customer funds, they’ll have to start preparing lawsuits against third-parties. These potential “deep-pockets” include directors, JP Morgan, Jeffries, who underwrote the bond issue in August, and auditor PwC.

The Department of Justice will be forced to file criminal charges against someone.

What evidence will they base these lawsuits and criminal complaints on? Typically, a bankruptcy trustee hires a bankruptcy examiner to develop the theories and uncover the evidence used to hold executives, directors, bankers, underwriters, auditors and attorneys responsible for the failure of the firm and any fraud.

That hasn’t happened here. Why not?

Just look at the Refco bankruptcy, infamous predecessor firm of MF Global that also went down in flames from fraud and declared bankruptcy. Bankruptcy examiner Joshua Hochberg produced a bang-up report that pointed to several parties where recovery was possible. The trustee is still litigating on behalf of the estate, although it has not been easy. Criminal conduct was suspected from the start in the Refco case, too. Executives went to jail. That did not impede either making customers whole right away or going after third parties to make up the difference immediately.

Instead for MF Global we have a holding company Trustee more intent on protecting MF Global executives and a broker/dealer Trustee who’s had to be pushed kicking and screaming to respond to customers.

So much, also, for an investigation by the broker/dealer bankruptcy Trustee Giddens of what happened at MF Global by his law firm. Giddens’ firm is both customer and vendor to MF Global’s auditors, PwC and vendor to JP Morgan, MF Globals banker and biggest creditor. And so much for an investigation by the broker/dealer trustee that uses Ernst & Young as forensic accountants, the same firm, according to sources, that designed and implemented MF Global’s internal controls in time for their first Sarbanes-Oxley review and the firm that Randy McDonald, the MF Global CFO prior to current CFO and PwC alumni Henri Steenkamp, came from.

If it was only the SEC abetting the obfuscation of helpful information, I’d maybe accept an excuse that the volume of filings from broker dealers precludes the detailed review of the content or SEC action on any information, such as discrepancies in controls over segregated assets noted by an auditor, until it’s too late.

But the CFTC, who seems to be using leaks to the press to deflect attention from its own role and responsibility for keeping an eye on customers’ money, is doing it, too. There is no data regarding status of segregated customer assets for MF Global on the monthly required regulatory report for FCMs posted by the CFTC for September, 2011.

I asked the CFTC:

“Did MF Global submit their data as an FCM for September on time within your required timeframe? If the CFTC received the data on time, why did the CFTC decide not to publish MF Global’s numbers as of September 30th? The full report was posted to the website on November 10, after the October 31 bankruptcy, but the data is “as of” September 30 when the firm was still in business.”

The CFTC spokesperson would not go on record with his response. Based on our conversation and the policies published on the CFTC ebsite of handling this report, I’ve determined that the September 30, 2011 financial statement filings for all FCMs, FCM/BDs, and RFEDs were originally due October 26th. The CFTC gives itself 12 business days after the due date to publish. It appears that organizations were given additional time due to the Veteran’s Day Holiday. The Commission sates that it “generally” publishes data for active FCMs only. MF Global Inc. declared bankruptcy October 31, 2011. At the time the September data were posted, MF Global Inc. was no longer an active FCM and therefore the firm and its data was deleted for the report.

Was there something about what MF Global reported for September regarding its required customer segregated funds position that in retrospect, post liquidation and holding company bankruptcy filing, would be embarrassing to the CFTC? Did MF Global report at all and on time? Did the CFTC have a head start on the MF Global situation that they did not act on?

We will never know since so much information that’s supposed to be public, transparent, and informative is being held back from the public, from investors, and from the MF Global customers still waiting to get their money.

My conclusion on this matter has not changed from the very inception of this grand larceny. It is not surprising that there are thieves in the financial world. What is surprising is that regulators of the U.S. government (SEC, CFTC)oversaw the entire theft, drove the get away truck and now want to secretly hide their incompetency away in a dark closet for none to see.

Pay close attention. This is how it happens…

President Obama found a moment of reduced visibility, in an unwatched hour on New Year’s Eve, to sign the latest assault on the Fifth Amendment. In signing the National Defense Authorization Act of 2012 on New Year’s Eve, Obama knew the nation’s attention would be elsewhere, diverted by revelry, football, New Year’s Day, and a Monday national holiday.

In case you haven't heard, the National Defense Authorization Act allows the government to detain people indefinitely – yes, it includes American citizens who can be taken even on our native soil and imprisoned – merely on the basis of accusations.

The measure is "so radical," says Human Rights Watch, "that it would have been considered crazy had it been pushed by the Bush administration." And although Obama appended a signing statement as he put his name to the act, solemnly assuring the nation that the power he insisted on having won’t be used recklessly, it is a political gesture that has no more force of a law than attaching a little yellow sticky note to the bill. If the clear language of the Constitution itself cannot bind the governing classes, it is hard to imagine a post-it note having much effect on the current or future presidents now that the indefinite detention of Americans without trial has been legislatively countenanced.

There you have it in a nutshell, the new American way: Guilty until proven innocent.

This is how once-free people slip into state tyranny and slide into martial law.

Political figures are always careful to paper over their power grabs with spurious legalities and midnight measures, granting themselves the rights they are appropriating. No matter how flimsy the pretext, no matter how forbidden the act, everything must be formalized and enabled. Overturned rights and the pretext of legality.

That is how the Fourth Amendment was trashed… marginalized by a document called the Patriot Act.

And now the Fifth Amendment is under attack.

But you shouldn’t be surprised. If the president of the United States can have you, an American citizen, assassinated on his own say so, how much of a shock is it to find that he can have you arrested and held without any of that pesky Fifth Amendment due process business?

Of course, in trying to outdo Bush, Obama has all along claimed the right to detain Americans without interference from the Bill of Rights. In making this extraordinary claim, Obama relied on the 10 year old Authorization for the Use of Military Force, the measure authorizing the pursuit of those responsible for 9/11. But now this broad interpretation of the authority to go after the likes of Osama bin Laden has been extended to nullify whole sections of the Bill of Rights. Obama’s reading of his authority, radical to begin with, has now been handed to him in a statute, codified in a pile of paperwork called the National Defense Authorization Act, and tucked right in with the Pentagon’s budget.

It’s all part of the forever war on terror, after all.

And if the assault on the Fifth Amendment weren't enough, the Sixth Amendment was put on the table as well. Remember, that’s the one about "a speedy and public trial" and "an impartial jury." Well, that’s all but flushed. Forget "speedy." And "public" just left town. You can now be detained without a trial at all. Indefinitely.

America's Slippery Slope

How many points on the line does it take to recognize our downward slope into state lawlessness? Do we really need more than just the state claiming the right to arrest and hold the people without due process? Does it take more than the state assuming the right to assassinate them?

Warrantless surveillance? Torture? The state secrets privilege? Critics of the National Defense Authorization Act say it makes it easier for the government to render citizens to fascist proxy states where they can be tortured. Is that enough points on the line to see where we are headed?

Can the slide into state militarism be seen in serial wars, all undeclared? In the trillions of war spending that won’t be refused? Or in drones prowling overhead in what used to be called "our country," but has now been renamed with a term that echoes Nazi Germany: The Homeland?

Perhaps it is a slope that can be discerned in the threat of violence as the first tool of diplomacy. In the paramilitary forces and SWAT teams that are now part of virtually every federal department and agency. In the Freudian envy with which local police departments across the land ape the dress and manner of military operations. In the TSA Viper (Visible Intermodal Prevention and Response) teams that have now moved their surveillance of the American people beyond the airports and put them on the open streets of das Heimland.

It happens in every power grab in modern times. Like the National Defense Authorization Act, there is always a legalistic pretext upon which the power grab of the state relies. Lenin consolidated his control under the cover of a blizzard of legalistic decree-laws. Hitler promulgated his emergency decree "For the Protection of the People and the State" on the day of the Reichstag fire. That was followed by the "Enabling Act," which declared that laws of the Reich could deviate from the constitution.

Paper pretexts all, slow-motion coups in the small hours conferring the appearance of legitimacy as they subvert the people’s freedom.

Of course, most of the national news media, the lapdog press, will miss the latest assaults on the Bill of Rights. But do not assume it’s because they were all hung-over. It’s easier to believe that they just don’t care. If there is any dissent at all about this power grab, it will not be because of the attack on your freedom. The national talk shows will see it as important only to the extent that it allows their favored team, red or blue, to move the ball down the field.

But where are America’s sworn defenders of the Constitution? With raised arms, all federal officeholders mouth the words, "I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same…"

MANHATTAN (CN) - An American expatriate in Bulgaria claims the United Nations, the World Economic Forum, the Office of International Treasury Control and the Italian government conspired with a host of others to steal more than $1.1 trillion in financial instruments intended to support humanitarian purposes.
The 111-page federal complaint involves a range of entities common to conspiracy theorists, including the Vatican Illuminati, the Masons, the "Trilateral Trillenium Tripartite Gold Commission," and the U.S. Federal Reserve.
Plaintiff Neil Keenan claims he was entrusted in 2009 with the financial instruments - which included U.S. Federal Reserve notes worth $124.5 billion, two Japanese government bonds with a combined face value of $19 billion, and one U.S. "Kennedy" bond with a face value of $1 billion - by an entity called the Dragon Family, which is a group of several wealthy and secretive Asian families.
"The Dragon family abstains from public view and knowledge, but, upon information and belief, acts for the good and better benefit of the world in constant coordination with higher levels of global financial organizations, in particular, the Federal Reserve System," Keenan claims.
"During the course of its existence over the last century, the Dragon family has accumulated great wealth by having provided the Federal Reserve Bank and the United States Government with asset assignments of gold and silver via certain accounts held in Switzerland, for which it has received consideration in the form of a variety of Notes, Bonds and Certificates such as those described ... that are an obligation of the Federal Reserve System."
Keenan says that with accrued interest the instruments are now worth more than $1 trillion. He says the family designated him as its principal in an effort to select certain registered and authorized Private Placement Investment Programs (PPPs) for the benefit of unspecified global humanitarian efforts.
In his remarkable complaint, Keenan claims that the U.S. government enormous amounts of money - delivered in gold and other precious metals - from the Dragon Family many years ago, and that the money was placed into the Federal Reserve System for the benefit and underwriting support of the dollar, "which was to become and currently remains the global reserve currency".
Keenan claims the conspiracy began with the illegal detention of two Japanese citizens, Akihiko Yamaguchi and Mitsuyoshi Watanabe, and the seizure of $134.5 billion in bonds they were holding in Italy, in June 2009.
Yamaguchi can best be described as Keenan's predecessor in trying to place Dragon Family instruments in legitimate PPPs to advance the group's humanitarian aims, according to the complaint.
Keenan says he came to know both Yamaguchi and the Dragon Family through the Japanese man's efforts on the group's behalf, and that he introduced them to a bank in Cyprus with which they could do business.
Keenan says that in gratitude, Yamaguchi sought and was granted approval to execute a special power of attorney, whereby Keenan would also act on behalf of the Dragon Family to place their assets in PPPs.
It was then, he says, that he took possession of the instruments that are the heart of the lawsuit. For his assistance, Keenan says, he was to receive a profit share amounting to 30 percent of any particular PPP he arranged.
A month after the Japanese men were detained, an man named Leo Zagami, "a self-described 33rd degree Free Mason, who, as of April 2008, had reportedly claimed to be the leader of a breakaway faction of the Knights of Templar and high-level Freemasons centered around the elite of the Masons P2 (propaganda Due) Lodge in Monte Carlo," arrived on the scene, according to the complaint. (Parentheses in complaint.)
Zagami claimed to be a representative of the Vatican Illuminati and other European sect societies and "had been looking to make contact with certain Asian Secret Societies," the complaint states.
During a meeting in Japan, he says, he told a contact that Yamaguchi and Watanabe had been "set up" and that he had inside information about the seized instruments.
Subsequently, he introduced his contact in Japan to defendant Daniele Dal Bosco, a Vatican banker and associate of the P2 Masonic Lodge, who "would be able to 'cash the bonds seized by the Italian Treasury Police,'" according to the complaint.
The complaint alleges a complicated history with many moving parts and scores of internationally known and unknown characters, the sum of which is that Keenan claims he was entrusted with billions of dollars in bonds by the Dragon Family.
He claims that soon, he and Dal Bosco were in daily contact via Skype and they arranged to meet in Italy. During these conversations, Dal Bosco represented that he was not only financial advisor to Zagami, but also to the Vatican, Vatican City, Rome, and the treasurer for the P2 Masonic Lodge.
As a result, Keenan said, although he tried keep personal possession of the financial instruments with which he was entrusted, he nevertheless came to trust Dal Bosco, and turned the bonds over to him for "temporary safekeeping and custodianship".
Dal Bosco absconded with the bonds and sought assistance in selling the instruments "in the global marketplace through stealth, conversion and bribery," Keenan claims.
He claims that as the conspiracy continued to unfold, various high level officials repeatedly offered him a bribe of $100 million to "release" the instruments without disclosing their theft to the Dragon family, and to allow the instruments to be converted to a so-called UN "Sovereign Program" wholly under the auspices, protection and umbrella of the sovereign immunity enjoyed by the defendants.
Other defendants include UN General Secretary Ban Ki-Moon, Former Italian Prime Minister Silvio Berlusconi, Giancarlo Bruno, who is identified as head of the banking industry for the World Economic Forum, Italy's ambassador to the UN Cesare Maria Ragaflini, Ray C. Dam, president of the Office of International Treasury Control, and David A. Sale, the deputy chief of the council for the cabinet of the OITC.
Keenan seeks the return of the stolen instruments, punitive damages and court costs on multiple claims of fraud, breach of contract and violation of international law.

As part of a joint initiative with agencies in the USA and UK the Metropolitan Police Fraud Squad has issued warnings against a type of scam known variously as High Yield Investment fraud, Prime Bank fraud, or Advanced Fee fraud.

These schemes often refer to "Prime Banks" and offer excessively high rates of return in comparison with those that can be obtained in the legitimate financial market. Other claims include the ability to "block" the investor's funds in a bank account without risk for use in trading debentures and that Standby Letters of Credit can be discounted or traded for profits. Such schemes claim to operate with the full backing of the US Federal Reserve, IMF, World Bank, and so on. These statements are UNTRUE despite any claims to the contrary.

The following are typical features of such fraud:

A non-returnable up-front payment or deposit will be required
All dealings will be through agents
Documentation cannot be verified
All correspondence and documentation is sent by fax
The deal involves complex and unusual financial instruments
The purported principal is overseas and his identity cannot be revealed

The documents below are from a UCC-1 filing in the State of Washington concerning the Trask Group of Companies and The Clinard Family Living Trust. The sole purpose of this filing is to make something not real appear as real. It is just smoke and mirrors. In the recording and registering of Financial documents they usually appear on the following financial screens, The D.T.C (Depository Trust Corp), Bloombergs, Euroclear. The so called IBOE's listed in the documents below do not, have not ever appeared on any of the above named screens. We have seen thousands of Birth Certificate Bonds and that is actually what these numbers represent that are listed below. There is nothing that gives the IBOE's listed below any value at all. They will try and make statements that the Treasury of the United States will honor these IBOEs. When in fact the IBOEs are not real and a quick call to the FBI, Treasury Department will verify that.

AN INTERCEPTION IN ABRUZZO

Federal Reserve Scam Letter

We received some documents by email yesterday that concerns a letter that involves the Federal Reserve Bank and Homeland Security. We spent several hours on the phone with people from the Federal Reserve Bank in San Francisco, California as well as with the Federal Reserve and the Treasury Department and Homeland Security. We sent them copies of the documents below and they all stated that the documents are not real and that their agencies do not enter into any agreements like the documents below with private individuals. That documents like the ones below are typically used to scam people out of their money, assets, and property. They also stated that anyone that receives documents like the ones below should contact the FBI. We also learned that there is no department named Special Acquisitions Division of the Federal Reserve Bank of San Francisco nor is there anyone working at the Federal Reserve by the name of Robert Davis. We also called the number listed on the document that pretains to Homeland Security and no one answers the phone. So we contacted the Main office of Homeland Security and they also stated that the documents are not real. They have also suggested that if anyone has given any assets, property to these people they should contact the FBI.

Hon Yeung JA (giving the Judgment of the Court):

Introduction

1. The applicants, Zheng Shu Wu (“Zheng”), Shum Yung Sang (“Shum”) and Xu Wei (“Xu”) were jointly charged with one count of conspiracy to use false instruments with the intention to induce somebody to do some act to his own prejudice. Xu was further charged with one count of possession of false instruments.

2. The applicants pleaded not guilty and were convicted after trial before District Judge Douglas Yau on 19 November 2009. They were each sentenced to three years’ imprisonment. At one stage they sought leave to appeal against both conviction and sentence, but all of them subsequently abandoned their application against sentence. We only need to concern ourselves with their application against conviction.

The prosecution case and evidence

3. The prosecution alleged that the applicants conspired to use a batch of forged Hongkong and Shanghai Banking Corporation (“HSBC”) certificates of deposits worth hundreds of billions of dollars to demonstrate that they had sufficient financial resources to successfully participate in an intended project to build a geothermal power plant in China by an American company, Elemental NRG (“Elemental”). Since the partners in Elemental requested the applicants to produce proof of funds issued by the bank, they in turn asked HSBC to verify the batch of false certificates of deposits and issue proof of capital.

4. The prosecution called numerous witnesses, whose evidence was largely not in dispute.

5. There were three partners in Elemental, namely Robert Joseph Tomacari (“Tomacari”), Michael Edward Mckie (“Mckie”) and William Mayer (“Mayer”) (deceased). Tomacari and Mckie were called as prosecution witnesses at the trial.

6. In his evidence, Tomacari described how Elemental intended to build a power plant and went searching for investors. He indicated that he learnt through a friend, Cheung Sin Kong (transliteration), that some mainlanders who had huge deposits in HSBC were interested in making the investment. According to Cheung, such information came from his friend, Chan Chi Yong (transliteration).

7. On 18 January 2009, Tomacari, Mckie and Mayer arrived in Hong Kong to meet the applicants. Cheung was present to act as their interpreter. When the applicants learned about the investment project, they showed Tomacari, Mckie and Mayer some photos depicting what appeared to be certificates of deposits of huge amounts and indicated that the money was in HSBC. Mayer asked the applicants to provide information about the history of the funds as well as a copy of the investors’ passports, so as to avoid any possible connection with the crime of money laundering.

8. Ms Yam Chi Wah (transliteration), a friend of Zheng’s, said in her evidence that Zheng had asked her to arrange a meeting with the staff of HSBC so that the bank could issue proof of funds. Zheng told Ms Yam that the project would involve an enormous amount of money which had been kept in the bank for a long time and that the holder of the funds would soon come to Hong Kong from Shenzhen. Zheng even told her that she hoped the bank could send people to the hotel to meet them since they were high officials.

9. Having made some enquiries, Ms Yam told Zheng that she found the matter suspicious. Zheng, however, replied that the three Americans had said there were no problems with the funds, and she even claimed that the matter concerned the Chinese party representing China and the US Federal Reserve. Zheng also introduced Shum and Xu to Ms Yam as her superior and the funds holder respectively. Zheng further indicated that they did not really want to withdraw the money but were just hoping that HSBC could issue proof of the funds.

10. Ms Yam eventually arranged for the applicants and Mckie, who was allegedly from the Federal Reserve, to meet Ho Kai Tat (transliteration), Deputy Manager of the Bank’s Investigation Unit, Lee Siu Keung (transliteration), Manager of the Insurance Unit and a staff member surnamed Kuk at the Langham Place branch of HSBC on 20 January 2009.

11. In his evidence, Ho Kai Tat said that during the meeting, Xu produced a wad of certificates of deposits totaling 100 pieces. When he indicated that he wanted to make photocopies of the certificates, Shum insisted on being present. Zheng and Xu said that they hoped the bank could verify the genuineness of such certificates, which were related to some of Mckie’s investment projects. Mckie also indicated that there were some joint ventures and he had to see if the certificates of deposits were genuine. Xu claimed that he had about 200 certificates of deposits, which were obtained by his father from a Kuomintang high official and were given to him for handling in 2005.

12. Ho Kai Tat inquired with the applicants and Mckie respectively as to whether they required oral or written confirmation. Both parties indicated that they wanted the latter.

13. Lee Siu Keung also stressed that during the meeting, all the applicants asked HSBC to issue a confirmation letter verifying the false instruments specified in charge 1.

14. Cheung Sin Kong testified that he came to know there were mainlanders who wished to invest in Elemental’s project after contacting Chan Chi Yung. Hence he arranged for Tomacari, Mckie and Mayer to meet the applicants. He confirmed that during the meeting, Tomocari indicated that he was not clear about the nature of the documents shown by the applicants and therefore asked them to provide verification certificates.

15. In fact, Lee Siu Keung had notified the police before meeting the applicants, which resulted in the arrest of the applicants at the scene for the offence of conspiracy to defraud.

16. Subsequently, the police found in the laptop computer inside Zheng’s hotel room images of the false instruments in question, including two deposit slips in the sum of US$217 billion, two monthly statements showing a balance of US$217 billion in the account, one confirmation letter issued by HSBC showing a deposit of US$217 billion in the account, one confirmation letter signed by Ms Diana Cesar of HSBC showing a deposit of US$55 billion in the account and guaranteeing that the funds were legitimate and “clean”. In fact, all those documents were false.

17. The police also found in Shum’s hotel room printed copies of the above images, a document bearing three deposit transfer notices, each in the sum of US$500 million and payable to “Lee Kwai Fa” (transliteration), two forged certificates of deposits in bearer form in the sum of US$500 million and other false documents.

18. The police found on Xu 104 forged certificates of deposits in the sum of US$500 million each, an envelope with the words “The Hong Kong Bank” printed on it, numerous forged certificates of deposits in the sum of US$500 million each, a copper plate engraved with the words “Hong Kong and Shanghai Banking Corporation account number 400 1523 72124, code 414153 Li Lie Jun (transliteration) 500,000,000” and a document holder containing two documents, namely, “Authenticated Power of Attorney” and “Authenticated Authorization Letter”, two copies of “Inheritance Letter”, two copies of “Power of Attorney” and one “Authorization Order” entitled “17 Plum Blossom Alliance of the Republic of China”. Xu also had on him a seal engraved with the words “Li Hou Long (transliteration) Money Withdrawal Seal”, a silver plate engraved with the words “Bestowed Copy from the Chiu’s Mansion of the Republic of China”, a metal seal and a handwritten “Acknowledgement of Receipt of Certificates of Deposits” dated 17 January 2009.

19. During her interview with the police, Zheng claimed that her company was involved in various investment projects and she had been seeking investors in eight of such projects but in vain. She said that when she met the partners in Elemental, she did not understand what Mckie was saying and just thought that he had funds and would invest in the projects that she devised, rather than they investing in Elemental’s geothermal project. Zheng admitted that the photos in her computer were photos of the certificates of deposits provided by Xu, which were taken by Shum on the morning of 17 January 2009. Those certificates of deposits were wrapped up and kept by Xu afterwards.

20. During his interview with the police, Shum said that he knew Xu had been in possession of the certificates of deposits in question for a month. At that time a female friend surnamed Zhang (transliteration) took a scanned voucher to their Yong He Company (transliteration) in Beijing and showed it to Xu. Since she knew that Zheng was seeking capital, she brought along the scanned voucher to see if it would be useful. Xu indicated then that he was able to find similar things. Shum stressed that both Zheng and Xu were present when Ms Zhang showed them the scanned voucher. Later, Shum changed to say that Xu was not present. In clarification, Shum said that when Ms Zhang took the voucher to Yong He Company to show Zheng, she indicated at the same time that the voucher was worth a lot of money.

21. Shum also claimed that all the documents seized by the police in his hotel room were given to him by a mainland lawyer surnamed Yao (transliteration) and that he did not know what documents they were. He just casually put them in the bag, while the other certificates of deposits were given to him by Xu for safekeeping.

22. Shum’s case was that he was only assisting Zheng in seeking capital and Xu happened to own many certificates of deposits that could be used. Shum claimed that their purpose was to test the genuineness of the certificates which, if found to be genuine, would provide them with funds. Shum also said that the lawyer surnamed Yao was the one arranging for the investment behind the scene.

23. In his interview with the police, Xu claimed to be a son of General Li Lie Jun of the Kuomintang, who passed him to a foster father after his birth in order to cover his identity. It was only in 2005 that he realized his real name was Li Hou Long and he owned national assets in astronomical sums. He said the assets were jointly owned by the Communist Party and the Kuomintang.

24. Xu said that the documents in question and the other jewellery were obtained by him from a hill and they originally belonged to his family. The bonds were obtained by his father who exchanged a hundred taels of gold and jewellery for them with HSBC between 1922 and 1927. He described his illustrious family background, but at the same time he also said that his foster parents hanged themselves because of him during the Cultural Revolution.

25. According to Xu, in his home there was a set of coordinates which showed 108 armouries, while the bonds were hidden in a hilltop whose location was a secret that could not be revealed, with him being the only one who knew about it. When asked about the identities of the other people keeping the bonds, Xu said he was not willing to answer. Xu said that he chanced on Zheng and Shum and with their assistance, he brought the certificates of deposits/bonds to Hong Kong for verification.

Defence

26. Much of the prosecution case was not in dispute. The applicants agreed that they had the agreement to meet the partners in Elemental and show the certificates of deposits in question in order to demonstrate that they had the financial resources to participate in the relevant investment project. The applicants also agreed to meet the staff of HSBC and show them the certificates of deposits in question for the purpose of asking HSBC to verify them and issue proof of funds. The applicants even agreed that the certificates of deposits in question were false and that they voluntarily took part in the interviews with the police to give their explanation of the matter.

27. None of the applicants gave evidence in their defence, nor did they call any witnesses. Basically, their case was that they did not know or believe that the certificates of deposits in question were forged and that the prosecution evidence was not sufficient to prove that they did conspire to use false instruments. In respect of charge 2, Xu’s case was that although the instruments in question were false, he was not aware of that and the things that he had provided to the police, namely, the “Authenticated Power of Attorney” and “Authenticated Authorization Letter”, “Inheritance Letter”, “Power of Attorney”, “Authorization Order” and the “seal”, etc were all consistent with his case that he had no knowledge.

The trial judge’s findings

28. The trial judge rejected the explanation given by Zheng at her interview with the police and dismissed her description of the investment projects as a pack of lies. He did not accept her account of how she contacted Shum and Xu, nor did he accept her claim that she was not aware of the photos and documents in her computer and their contents. The trial judge totally rejected the explanation that Shum and Xu gave in their interviews with the police. He found that they were lying and engaged in fabrication.

29. The trial judge found that the certificates of deposits were forged and that Zheng was aware of the existence and nature of those forged certificates. He inferred that Zheng, Shum and Xu conspired to use those false certificates of deposits with the intention to induce HSBC to issue proof of funds, and that during their meeting with the staff of the bank on 20 January 2009, they intended to carry out their conspiracy to commit the offence.

30. The trial judge stressed that at the material times, Shum was in possession of some false certificates of deposits in the sum of hundreds of billions of dollars together with some false monthly statements and time deposits vouchers. He found that Shum must have known or believed that the documents presented to the staff of HSBC for verification were false and that their purpose was to defraud HSBC into issuing to them some proof of funds. The trial judge also found that Shum, Zheng and Xu did have an agreement to conspire to defraud and an intention to carry out such an agreement.

31. The trial judge was of the view that the applicants must have known of the falsity of the certificates of deposits in question, and their plan to defraud HSBC so as to obtain proof of funds was entirely feasible. The reason was that if HSBC said that the documents were false, all they had to do was just to insist their innocence; but if HSBC had said the documents were genuine, their plot would have succeeded. The trial judge regarded them as a group of organized, bold and scheming fraudsters, whose plot allowed for an excuse to get away in case of failure, namely if their fraud was exposed they would claim themselves to be victims as well.

32. The trial judge found that in respect of the first count of conspiracy to use false instruments with the intention to induce somebody to accept it as genuine and hence to do or not to do some act, the “somebody” referred to therein were the staff of HSBC who met them on the material day, i.e. Ho Kai Tat and Lee Siu Keung. The reason was that the applicants showed Ho and Lee those false instruments and asked them to verify their genuineness.

33. On that basis, the trial judge convicted the applicants on the first count.

34. In respect of the second count, the trial judge also rejected the explanation given by Xu at his interview with the police and dismissed his claim that he had obtained the false certificates of deposits in a cave as a pack of lies. The judge stressed that Xu’s explanation indicated that what he described was his personal experience rather than second hand knowledge, but his explanation was not true at all. The judge found that the only inference to be drawn was that Xu used an excuse to commit the fraud and he must have known that the certificates of deposits in his possession were false instruments. Since he had no lawful authority or excuse to possess those false instruments, the judge accordingly convicted him on the second count as well.

Grounds of Appeal

35. Basically, Mr Lawrence Lok SC on behalf of Zheng and Shum raised only one ground of appeal.

36. Mr Lok SC submitted that the prosecution clearly stated in their opening that the targets of the applicants’ fraud were Tomacari, Mckie and Mayer rather than the staff of HSBC, hence the applicants’ closing submission focused on the words and demeanor of the said three persons. The trial judge, however, in the absence of any indication, changed the targets of the applicants’ fraud to the staff of HSBC and convicted Zheng and Shum on that basis. Mr Lok SC submitted that in doing so the trial judge had caused grave injustice, which rendered his conviction of Zheng and Shum on the first count unsafe.

37. Apart from taking the same stance as Mr Lok SC on the above issue, Mr Kan Ding To on behalf of Xu also submitted that the trial judge had failed to appropriately analyze Xu’s record of interview with the police and wrongly found that his account was fabricated.

38. Mr Kan submitted that although Xu’s description of how he came to obtain the certificates of deposits was rather dramatic, the trial judge had no basis to reject his account in the absence of any evidence to the contrary adduced by the prosecution. Mr Kan stressed that part of the exhibits that Xu had provided to the police, including the “Power of Attorney”, “Letter of Authorization”, “Inheritance Letter”, “Authorization Order” and the “Seal”, etc could all lend support to his explanation. When the trial judge considered whether Xu’s explanation was credible, however, he made no mention of such documents, which showed that he had not fully taken that evidence into account.

Discussion

39. According to the evidence that was not and/or could not be disputed, at the material times the applicants were in possession of certificates of deposits worth hundreds of billions of dollars. They expressed an interest in investing in Elemental’s power plant project, and through the arrangement of a third party, they met the three partners in Elemental in Hong Kong on 18 January 2009. During the meeting, the applicants showed the partners in Elemental photographs relating to the funds for the purpose of convincing them that they owned the relevant funds. The applicants directly or indirectly revealed that the funds were deposited in HSBC, but they offered no proof as to the form in which the funds existed, nor did they explain how they intended to use the funds.

40. When the partners in Elemental requested the applicants to provide information about the history of the funds, Zheng, through Ms Yam Chi Wah, attempted to obtain “Proof of Sums” issued by HSBC.

41. Zheng even told Ms Yam that the matter concerned the Chinese side and the US Federal Reserve. Shum was her superior while Xu was the funds holder. Zheng said that the funds had been in the bank for a long time and they hoped that HSBC could issue proof of funds.

42. The applicants acted in concert, hoping first that they could convince the partners in Elemental that they owned sufficient funds to invest in the relevant project. When Mayer asked them to provide proof of the funds, they attempted to obtain proof of funds issued by HSBC.

43. The documents or images that the applicants possessed and showed to the partners in Elemental and/or HSBC were false instruments.

44. If the applicants acted jointly in showing the partners in Elemental and/or HSBC the false instruments in question or their images or copies while knowing or believing the same to be false, for the purpose of convincing the partners in Elemental to allow them to invest in the relevant project and/or asking HSBC to verify them and issue proof of funds, the applicants must have committed the offence of conspiracy to use false instruments.

45. The first charge against the applicants alleged that they, on or about 20 January 2009, in Hong Kong, used the false instruments in question with the intention to induce somebody to accept them as genuine, and by reason of so accepting them to do or not to do some act to his own or any other person’s prejudice.

46. The particulars of the above offence could cover the applicants’ act of meeting the partners in Elemental on 18 January 2009 and also their act of meeting the staff of HSBC on 20 January 2009.

47. In fact, the brief facts of the prosecution case set out the details of the applicants’ dealing with the partners in Elemental as well as their dealing with the staff of HSBC.

48. However, when the parties were dealing with issues relating to the Practice Directions 9.1, namely the proper approach to be adopted when the indictment includes both a conspiracy charge and a substantive charge, the then prosecuting counsel made the following submission:

“In respect of the first charge, your Honour, the prosecution case is that the three defendants conspired to use these documents, the five documents set out in the charge, which are in fact 104 pages, in total, that is, to defraud, namely conspiracy to (original in English) – conspiracy to use these documents, well, to – I used the word “conspiracy” which may not be very appropriate, but basically they were hoping to induce two foreigners, … to believe that they were genuine, and then to allow the defendants to participate in some investment projects, well, that is… put simply, a summary of the facts relating to the first charge, well, what I’m talking about is the way in which they used these document to do such a thing… in respect of the second charge, …the facts are of a much narrower scope…”

49. The prosecuting counsel used words like “basically”, “put simply” and “a summary” to describe the particulars of the first charge, which, when considered together with the brief facts of the case, made the applicants’ allegation, namely, that the prosecution clearly stated in its opening that the target of the applicants’ fraud were only the partners in Elemental and had nothing to do with the staff of HSBC, very much debatable. Their criticism of having been misled by the prosecution was also far from convincing.

50. In fact, the defence did not ask the prosecution to choose between the partners in Elemental and the staff of HSBC as the targets of the applicants’ conspiracy to use false instruments, and accordingly the prosecution did not do so in the absence of any such request. Indeed, that matter was never in issue or of concern to the parties.

51. All the applicants complained that it was unfair to them for the prosecution to state in their opening that the victims in the case were the partners in Elemental while the judge found that the “victims” were the staff of HSBC. Mr Lok SC argued that if the “victims” were the partners in Elemental, the applicants would not dispute the allegations that they “induce them to accept the vouchers in question as genuine” and “by reason of so accepting them to do or not to do some act”, the reason being that the meeting with the partners in Elemental was only arranged for the purpose of discussing how to use the vouchers in question. If the victims were the staff of HSBC, however, the applicants would have to dispute the above two allegations, since the purpose of the applicants’ meeting with the bank staff was to verify the genuineness of the documents, and the possibility of inducing ordinary people to accept the vouchers in question was different from that of inducing the staff of a bank to accept them. Mr Lok SC also stressed that the applicants would definitely have addressed the court on the above issue.

52. The applicants met the staff of HSBC on 20 January 2009 for the purpose of asking the bank to verify the genuineness of the vouchers in question and to issue verification confirmation.

53. According to the evidence of the prosecution witnesses, including that of Yam Chi Wah, Ho Kai Tat, Lee Siu Keung and Cheung Sin Kong, the applicants’ ultimate purpose was to ask HSBC to issue verification confirmation.

54. HSBC, of course, would not issue any such confirmation. Right from the beginning the staff of the bank had suspicions about the genuineness of the vouchers in question, and the case had been reported to the police for record purposes even before the meeting with the applicants.

55. Nevertheless, the issue in the case was not whether the applicants did conspire to use false instruments with the intention to induce others to accept them as genuine or whether their intention could be successfully carried out. The issue in the case was simply whether the applicants were aware of the genuineness or otherwise of the documents in question. That was also the only defence put forward by the applicants.

56. Mr Lok SC submitted that the applicants would have disputed the allegations that they “induce them to accept the vouchers in question as genuine” and “by reason of so accepting them to do or not to do some act”. We are of the view that such an argument is not convincing. In our view, whether the applicants could successfully induce the “victims” to accept the vouchers in question as genuine and whether the “victims” would accordingly do or not do some act was irrelevant to the issue in the case.

57. Of course, the court and the defence are entitled to know the factual basis upon which the prosecution has conducted the case against a defendant (see R v Chan Kang To [1997] 2 HKC 281, HKSAR v Cheung Hing Man & another (CACC 91/2008, etc). However, when the court convicts a defendant on a different basis from that put forward by the prosecution, the decision to convict is not necessarily so unsafe that it has to be quashed. In R v Leung Mun Lam [1985] 1 HKC 535, the Court of Appeal clearly ruled that whilst a judge in his direction to the jury departs from the basis upon which the prosecution has conducted the case, such a departure is not invariably fatal. The Court of Appeal still have to consider whether the trial judge’s approach has rendered the verdict of conviction unsafe or unsatisfactory, and only in circumstances where the conviction is found to be unsafe or unsatisfactory would the conviction be quashed.

58. In support of the above views, Yang JA (as he then was) cited R v Oakwell [1978] 1 WLR 32 where Lord Widgery CJ said in these terms:

“We think the proper approach to the argument put forward on this point is this. It is not the obligation of the judge precisely and exactly to follow the presentation of the case as put before him by the prosecution. What the judge has got to do is to secure a fair and sound conclusion at the end of the case. If the judge does not strictly follow the form of presentation which the prosecution have chosen to adopt, then it is always open to the defence to contend that that has resulted in a verdict which is unsafe or unsatisfactory. It does not, in our judgment, in general amount to an irregularity at the trial within the meaning of the Criminal Appeal Act 1968. But undoubtedly where the prosecution approach is departed from by the trial judge it is open to the defence to contend, if they can, that the verdict is thereby rendered unsafe or unsatisfactory.”

59. Even if the trial judge has departed from the prosecution approach, as long as that does not result in any injustice, and given the elements of the basis of conviction are no different from the fundamental allegation of the prosecution, then the verdict of conviction will not be unsafe or unsatisfactory.

60. We wish to quote a passage from page 606 of the judgment in R v Japes [1994] Crim LR 605:

“The judge was not bound by the way in which the Crown opened the case. If, in the light of the evidence as it developed, it became apparent that the same offence was or might have been committed on a somewhat different factual basis, it could not be right to consider, even though it might not be the primary basis put forward by the Crown, so long as it was plain that the defendant was not disadvantaged or prejudiced by the judge so doing.”

61. The applicants were not disadvantaged or prejudiced by the trial judge taking the staff of HSBC as the targets of their fraud rather than the partners in Elemental. The main ground of appeal put forward by the applicants fails.

62. Mr Kan submitted that the process of Xu’s obtaining the certificates of deposits was dramatic, but in our view Xu’s version was simply bizarre. Considering the nature of the certificates of deposits in question against the background of this case, the trial judge was absolutely justified and correct in completely rejecting the explanation that Xu gave in his record of interview.

63. The applicants made use of some false instruments to ask HSBC to verify them and issue confirmation. Their intention was specific and was not in issue. It was simply groundless for Mr Kan to contend that the trial judge had not fully considered whether the applicants had intended to induce the staff of HSBC to accept the instruments as genuine and by so accepting them to do or not to do some act to their own prejudice.

64. The fact that the applicants failed to successfully mislead the bank staff and that the bank staff did not verify the certificates of deposits in question and issue confirmation as per their request does not mean that the applicants had no intention to induce them to do so, nor does that mean that their purpose was not to make the bank staff do some act to their own prejudice.

65. Mr Kan submitted that the process of Xu’s obtaining the certificates of deposits in question was dramatic. In our view, his version of events was no more than a pack of lies. We have carefully read and analyzed the explanation that Xu gave in his interview with the police. We consider it so ridiculous that no person in his right mind would accept or believe. The trial judge must have carefully considered Xu’s explanation before he arrived at the conclusion that “Xu’s version was utterly bizarre and beyond belief.”

66. In his deliberation, the trial judge obviously took into account such documents and evidence as the “Power of Attorney”, “Letter of Authorization”, “Inheritance Letter” and the “Seal” that were in Xu’s possession at the material times. In fact he did set out those documents and exhibits in paragraphs 15 and 16 of his judgment.

67. The prosecution did not call any expert evidence to prove the falsity of the documentary exhibits, but considering the background of the present case, that would not affect the trial judge’s verdict at all.

68. Further, the explanation given by Xu in his interview was just his one-sided story which was not put to any test in terms of cross-examination. The trial judge was absolutely justified and correct in completely rejecting his explanation.

69. In respect of the two charges, the defence put forward by the applicants was merely that they had no knowledge of the false instruments in question.

70. The only inference that the trial judge drew was that the applicants had reached an agreement to obtain certain advantages with the false instruments set out in charge 1, which would include the inference that they must have known that the instruments were false when they were handed to the staff of HSBC for verification. In our view, the trial judge was entitled to reach the above conclusion, especially in circumstances where the applicants neither gave evidence nor called any witnesses to rebut or weaken the prosecution case against them.

71. Similarly, the trial judge was entitled to infer that Xu knew that the instruments in his possession, namely the false “certificates of deposits” set out in charge 2, were all false instruments. Xu did not have any lawful authority or lawful excuse about his possession of those false instruments. The guilty verdict that the trial judge reached was inevitable.

Conclusion

72. We are satisfied that the applicants’ conviction was neither unsafe nor unsatisfactory. The application for leave to appeal is dismissed.

Fist it must noted that there has never been a billion dollar bill printed by the Federal Reserve. Second the picture on all of these bogus bill is the wrong President by that we mean that has never been a President's image that has appeared on more than one bill. In other words Cleveland's picture is on the $100,000 dollar bill not the Billion dollar bill. Because Cleveland's picture appears on these phony bill is a hint that it is a phony. Plus scammers are trying to sell the phony bills as historical paper when in fact they are not and are worthless. If you go up to the Federal Reserves site you will be able to see the first image below and you will find out that it is still illegal to even possess a $100,000 dollar bill.

Threatening Phone Call from People claiming to represent Lord Neil B Gibson

I was setting at my girlfriends tonight and got a strange phone call from some people claiming to be in Greece. It was 3 p.m. here in California and 1 a.m. in Greece. They called me on a cloned phone with a number that belongs to a woman in Arkansas who told me that no call was made from her number. I explained to her that is was her number that came up in the caller ID. Well these people tried to claim that I owned some fraud website which has a lot of information concerning various individuals that are running scams. They also have a list of phony banks as well. I have nothing to do with the fraud website. In fact the fraud website is trying to do a hatchet job on me with a lot of misinformation and all of it false.

These guys called me representing themselves as representatives of Lord Neil B Gibson, they proceeded to threaten and intimidate me at which time I just hung up on them. Then I called the number that showed up in my caller ID. I do not know if these people represent Lord Neil B Gibson but they did claim to represent him. I am used to getting threats because of my project. They also mentioned Graham Shandiman and I told them that he is in jail in Bangkok. Again I want to make this perfectly clear that I do not know if these people really do represent Lord Neil B Gibson, they claimed that they did.

I called my attorney and explained to him what had transpired on the phone. I also talked with the FBI because this constituted a threat. If they were in fact calling from Greece then the threat was made across International lines as well State Lines. They did not even call from their own phone number they had to use a cloned phone. This type of behavior is what crooks do, they try to instill fear that something very bad is going to happen to you. One of my attorneys was threatened by Dimitri N Kanavos and he is a crook and a scammster there are plenty of people that he scammed waiting to get their money back.

We have even been presented with some of this paper that is phony. We have counterfeit $500 Federal Reserve Notes. In storage we even have originals of phony documents from Nigeria that were involved in a 419 scam.

For those that do not know the Tesoro News Blog is hosted by another server seperate from the Tesoro del alma website. We did that on purpose. The web hosting company that hosts the Tesoro Del Alma website has had some hardware issues so the website is on sometimes and off other times. They have told me that they are getting the problems resolved. But the blog site is up and running without any problems. We have also learned that the BLM has provided such information to discredit Tesoro Del Alma. They are trying to make Tesoro Del Alma appear to be less than human. They are so bent on preventing us from accomplishing our goals that they will do any and everything possible to accomplish that thru a link that they have to various Chinese websites.

If you want to know what elements are taking over in America and how government, specifically New Mexico’s Bureau of Land Management, addresses issues they cannot win in a court of competent jurisdiction, you need only to go to this site and see the handy work the BLM has used to discredit the Tesoro Del Alma project. We at the moment are looking for someone to send to us the documents concerning the phony trade program that Forrest Woody Davis is telling people is about ready to pay out. So far none of the documents that we have seen covering any and everything that Forrest Woody Davis claims is real is not. He is telling people that there are some people who are angry because they have not received what they were promised have been using me to get back at him and is delaying the payment that these people have coming. The two to three different attorneys that he uses to prepare the documents are under investigation by the various State Bar disciplinary boards. A couple of them have had criminal complaints filed against them. I guess that the attorneys do not realize that if they are part of a criminal conspiracy then RICO charges can be filed against them. We have decided to post the actual documents where Bill Childress of the Las Cruces BLM clearly states "The MPO will be approved with modifications in order to meet the requirements of the 1872 mining law and facilitate development of the mining claims. Approval of this MPO, however, does not constitute confirmation of claim validity or the presence of mineral discovery.

This proposed action conforms to the White Sands Resource Are, Resources Management Plan (RMP), October 1986 because the Plan states that public lands is generally open to mineral entry (White Sands R.M.P., p. 22-26), and Tesoro Del Alma holds active mineral claims for the project area. The Tesoro Del Alma Project Area is open to mineral entry under the 1872 Mining Law.

As you can see Bill Childress has signed these documents and clearly stated that the MPO will be approved. At this point we have no other choice but to believe that Bill Childress of the Las Cruces BLM is not a truthfull person his only intrest is to keep delaying the approval of the MPO. Luckly the Mining Law allows us to remove 1000 tons of ore while we are waiting for the BLM to do the right thing.

In “The Rising Financial Gold Market,” I highlighted how countries, such as Mexico, Russia and Thailand, were adding to their gold reserves. And in 2010, central banks became a net buyer of gold for the first time in 21 years, according to the World Gold Council.Central bank gold buying could soon be matched with other global banks if gold’s quality as an asset gets upgraded to Tier 1 status by the Basel Committee on Banking Supervision (BCBS).The BCBS is an international banking supervisory committee that provides a forum for determining global standards to ensure that banks all around the world have adequate capital. The group is comprised of members from all over the world, including Brazil, Canada, Germany, Hong Kong, Mexico, South Africa, Turkey, the U.K. and the U.S.After the global economic crisis, its top priority was to increase banks’ ability to absorb market shocks. One way to do this was to raise the percentage of common equity–considered the least risky of banks’ assets–that banks were required to hold from 2 percent to 7 percent.The BCBS has three tiers to grade the quality of capital held by financial institutions:Tier 1 – A high quality, liquid asset that must have exchange-related characteristics. Criteria include low credit and market risk, certainty of value, low correlation with risky assets, and listing on a developed and recognized exchange. There are also market-related criteria to determine whether an asset is a part of an active market, there are adequate market makers and what happens to the asset’s value when there’s a flight to quality. Tier 2 – These assets are considered “secondary bank capital.” These assets were never clearly defined and contain a range of assets with varying degrees of liquidity. Many of these assets could quickly lose value if liquidity dries up. Investopedia says this includes undisclosed reserves, general loss reserves and subordinated term debt—those that rate below other securities and are second in line when the debt gets paid out.Tier 3 – Tier 3 assets are similar to Tier 2, except that securities such as subordinated debt are in greater number. Investopedia says assets must be unsecured, limited to 250 percent of a bank’s Tier 1 capital, subordinated and have a minimum maturity of two years.Historically, securities such as sovereign debt have been considered high quality, liquid assets. As a Tier 1 asset, sovereign debt has been allowed a 100 percent required stable funding factor (RSF) applied in the net stable funding ratio. A day after the US downgrade to AA+, Warren Buffett (who elsewhere continues his op-ed uber-campaign in hypocrisy by writing in the NYT that the government should "Stop Coddling the Super-Rich") said that in his book the US is AAAA. Amusingly, hours later S&P downgraded Berkshire to pari with the US. Judging by the record near surge in volatility in the ensuing days, the market was not too convinced with the octogenarian of Omaha's latest orations. What it was more convinced by, judging by market results, was the fact that Bank of America upgraded something totally different to an AAAA rating: gold, with a $2000 12 month target. To wit: "High commodity prices have now created a terms-of-trade shock for importers, feeding into current accounts, the financial sector and, ultimately, sovereign debt. How will these imbalances unwind? Physical gold is the ultimate collateral because it has no credit risk, so EM Central Banks have been diversifying their foreign exchange reserves into gold and other non-dollar, non-euro assets in recent quarters. Looking ahead, the deterioration in credit quality in Europe and the US coupled with an increased probability of QE3 means these pressures will continue. As a result, we revise our 12-month gold target to $2000/oz." Basically everything that Zero Hedge has been saying for about two and a half years now. Naturally, this coming from Bank of America, should set of contrarian call alarm bells everywhere. The people of Iceland have now twice voted not to repay international debts incurred by banks, and bankers, for which the whole island is being held responsible. With the present turmoil in European capitals, could this be the way forward for other economies?

The small island of Iceland has lessons for the world. It held a referendum in April to decide, more or less, whether ordinary people should pay for the folly of the bankers (and by extension, could governments control the corporate sector if they depended on it for finance). Sixty per cent of the population rejected an agreement negotiated between Iceland, the Netherlands and the UK to pay back the British and Dutch governments for the money they spent to recompense savers with the failed bank Icesave. That was less resistance than the first referendum last spring, when 93% voted no.

The referendum was significant since European governments, pressured by speculators, the IMF and the European Commission, are imposing austerity policies on which their citizens have not voted. Even devotees of deregulation are worried by the degree of the western world’s servitude to unconstrained financial institutions. After the Icelandic referendum, even the liberal Financial Times noted with approval on 13 April that it had been possible to “put citizens before banks”, an idea which does not resonate among European political leaders.

Iceland is an unusually pure example of the dynamics that blocked regulation and caused financial fragility across the developed world for 20 years. In 2007, just before the financial crisis, Iceland’s average income was the fifth highest in the world, 60% above US levels; Reykjavik’s shops were stuffed with luxury goods, its restaurants made London seem cheap, and SUVs choked the narrow streets. Icelanders were the happiest people in the world according to an international study in 2006 (1). Much of this rested on the super-fast growth of three Icelandic banks that rose from small utility institutions in 1998 to being among world’s top 300 banks eight years later, increasing their assets from 100% of GDP in 2000 to almost 800% by 2007, a ratio second only to Switzerland.

The crisis came in September 2008 when money markets seized up after the Lehman meltdown. Within a week, Iceland’s three big banks collapsed and were taken into public ownership. Moody now listed them among the 11 biggest financial collapses in history.

Towards modernisation

After more than 600 years of foreign rule, Iceland’s social structure was the most feudal of all Nordic countries at the beginning of the 20th century. Fishing dominated the economy, generating most of the foreign-currency earnings and allowing the development of an import-based commercial sector. This created urban economic activities: construction, services, light industry. After the second world war the economy grew strongly, because of Marshall Plan aid (there was a large US-Nato military base); an abundant export commodity, cold-water fish, unusually blessed with high income elasticity of demand; and a small, literate population with a strong sense of national identity.

As Iceland became more prosperous it established a welfare state, in line with the tax-financed Scandinavian model, and by the 1980s had attained a level and a distribution of disposable income equal to the Nordic average. Yet it remained both more regulated and more patron-client-dominated than its European neighbours; a local oligopoly restricted the political and economic landscape.

There is a direct line of descent from the quasi-feudal power structures of the 19th century to the modernised Icelandic capitalism of the later 20th century, when a bloc of 14 families, popularly known as The Octopus, were the economic and political ruling elite. The Octopus controlled imports, transport, banking, insurance, fishing and supplies to the Nato base and provided most top politicians. The families lived like chieftains.

The Octopus controlled the rightwing Independence Party (IP) which dominated the media and decided on senior appointments in the civil service, police and judiciary. The local, state-owned banks were effectively run by the dominant parties, the IP and the Centre Party or CP (2). Ordinary people had to go through party functionaries to get loans to buy a car, or for foreign exchange for travel abroad. Power networks operated as webs of bullying, sycophancy and distrust, permeated with a macho culture, something like the former Soviet Union.

This traditional order was challenged from within by a neoliberal faction, the Locomotive group, which had coalesced in the early 1970s after law and business administration students at the University of Iceland took over a journal, The Locomotive, and promoted free-market ideas. Their aim was not just to transform the society but also to open career opportunities for themselves, rather than wait for Octopus patronage. At the end of the cold war their position strengthened materially and ideologically, as the communists and social democrats lost public support. The future IP prime minister, Davíð Oddsson, was a prominent member.

Oddsson, born in 1948 with a middle-class background, was elected as an IP councillor to the Reykjavik municipal council in 1974; by 1982 he was mayor of Reykjavik, leading privatisation campaigns, including selling off the municipality’s fishing industry, to the benefit of members of the Locomotive group. In 1991 he led the IP to victory in the general election, and reigned (not too strong a word) as prime minister for 14 years, overseeing the growth of the financial sector, before installing himself as governor of the Central Bank in 2004. He had little experience or interest in the world beyond Iceland. His Locomotive group protégé Geir Haarde, finance minister from 1998 to 2005, took over as prime minister shortly after. These two men most directly steered Iceland’s great experiment to create an international financial centre in the North Atlantic, midway between Europe and America.

Iceland liberalises

The liberalisation of the economy began in 1994, when accession to the European Economic Area, the free-trade bloc of EU countries, plus Iceland, Lichtenstein and Norway, lifted restrictions on cross-border flows of capital, goods, services and people. The Oddsson government then sold off state-owned assets and deregulated labour. Privatisation began in 1998, implemented by Oddsson and Halldór Ásgrímsson, the leader of the CP. Of the banks, Landsbanki was allocated to IP grandees, Kaupthing to their counterparts in the CP, its coalition partner; foreign bidders were excluded. Later, Glitnir, a private bank formed from the merger of several smaller ones, joined the league.

So Iceland roared into international finance aided globally by abundant cheap credit and free capital mobility, and domestically by strong political backing for the banks. The new banks merged investment banking with commercial banking, so that both shared government guarantees. And the country had low sovereign debt, which gave the banks high marks from the international credit-rating agencies. The major shareholders of Landsbanki, Kaupthing, Glitnir and their spin-offs reversed the earlier political dominance of finance: government policy was now subordinated to the ends of finance.

Oddsson and friends relaxed the state-provided mortgage rules, allowing 90% loans. The newly privatised banks rushed to offer even more generous terms. Income tax and VAT rates were lowered to turn Iceland into a low-tax international financial centre. Bubble dynamics took hold. City planners aimed to move Reykjavik from the trajectory of an ordinary city to that of a world city (despite its small population of 110,000) and approved several grandiose new public and private buildings, saying “If Dubai, why not Reykjavik?”

Iceland’s new banking elite were intent on expanding their ownership of the economy, competing and cooperating with each other. Using their shares as collateral, some took out large loans from their own banks, and bought more shares in the same banks, inflating share prices. It worked like this: Bank A lent to shareholders in Bank B, who bought more shares in B using shares as collateral, raising B’s share price. Bank B returned the favour. The share prices of both banks rose, without new money coming in. The banks not only grew bigger, they grew more and more interconnected. Several dealings of this kind are now under criminal investigation by the special prosecutor, as cases of market manipulation.

Tiny Iceland soon managed to enter the big-bank league, with three banks in the world’s biggest 300 by 2006. The super-abundance of credit allowed people to consume in extravagant celebration of their escape from the earlier decades of credit rationing (on top of the earlier escape from foreign rule as recently as 1944). They saw themselves as fully independent at last, which may explain their happiness ranking. The owners and managers remunerated themselves on an ever-larger scale. The richer they were, the more they attracted political support. Their private jets, roaring in and out of Reykjavik’s airport, seemed to be visual and auditory proof to the part-admiring, part-envious population below. Income and wealth inequality surged, helped by government policies that shifted the tax burden to the poorer population (3). The bankers made large financial contributions to the governing parties and giant loans to key politicians. The leading Icelandic champion of free-market economics declared in The Wall Street Journal: “Oddsson’s experiment with liberal policies is the greatest success story in the world” (4).

In the euphoria, the dangers of a strategy of “economic growth based on vast foreign borrowing” were overlooked. Icelanders lived out the dictum of Plautus, the third century BC Roman playwright, who had one of his characters declare: “I am a rich man, as long as I do not repay my creditors.”

The 2006 mini-crisis

In 2006 there were worries in the financial press about the stability of the big banks, which were beginning to have problems raising funds in the money markets (on which their business model depended). Iceland’s current account deficit had soared from 5% of GDP in 2003 to 20% in 2006, one of the highest in the world. The stock market multiplied itself nine times over between 2001 and 2007.

Landsbanki, Kaupthing and Glitnir were operating far beyond the capacity of Iceland’s Central Bank to support them as lender of last resort; their liabilities were real, but many of their assets were dubious. In February 2006 Fitch downgraded Iceland’s outlook from stable to negative and triggered the 2006 “mini-crisis”: the krona fell sharply, the value of banks’ liabilities in foreign currencies rose, the stock market fell and business defaults rose, and the sustainability of foreign-currency debts became a public problem, The Danske Bank of Copenhagen described Iceland as a “geyser economy” on the point of exploding (5).

Icelandic bankers and politicians brushed aside the crisis. Iceland’s Central Bank took out a loan to double the foreign-exchange reserves, while the Chamber of Commerce, run by representatives of Landsbanki, Kaupthing, Glitnir and their spin-offs, responded with a PR campaign. It paid the American monetary economist Frederic Mishkin $135,000 to lend his name to a report attesting to the stability of Iceland’s banks. It allegedly paid the London Business School economist Richard Portes £58,000 ($95,000) to do the same for a later report. The supply-side economist Arthur Laffer assured the Icelandic business community in 2007 that fast economic growth with a large trade deficit and ballooning foreign debt were signs of success: “Iceland should be a model to the world” (6). The value of the banks’ “assets” was then around eight times greater than Iceland’s GDP.

In the elections of May 2007, the Social Democratic Alliance (SDA) entered a coalition government with the still-dominant IP. To the consternation of many supporters, SDA leaders ditched their pre-election pledges and endorsed the continued expansion of the financial sector.

Though they had survived 2006, Landsbanki, Kaupthing and Glitnir had trouble raising money to fund their asset purchases and repay existing debts, largely denominated in foreign currencies. So Landsbanki pioneered Icesave, an internet-based service that aimed to win retail savings deposits by offering more attractive interest rates than high-street banks. Established in Britain in October 2006, and in the Netherlands 18 months later, Icesave caught the attention of best buy internet finance sites and was soon flooded with deposits. Millions of pounds arrived from Cambridge University, the London Metropolitan Police Authority, even the UK Audit Commission, responsible for overseeing local government funds, as well as 300,000 Icesave depositors in the UK alone.

Icesave entities were legally established as branches, rather than subsidiaries, so they were under the supervision of the Icelandic authorities, rather than their hosts. No one noticed that the Icelandic regulatory agency had a total staff, including receptionist, of only 45 and suffered high turnover as many went on to join the banks, which offered better pay. No one worried much that, because of Iceland’s obligations as a member of the EEA deposit insurance scheme, its population of 320,000 would be responsible for compensating the depositors abroad in the event of failure. Landsbanki’s shareholders reaped the short-term profits while most Icelanders didn’t know anything about Icesave at all.

Love letters

The second “solution” to difficulties in raising new funds was a way to get more access to liquidity without pledging real assets as collateral. The Big Three sold debt securities to a smaller regional bank, which took these bonds to the Central Bank and borrowed against them, without having to supply further collateral; they then lent back to the initiating big bank. The bonds were called “love letters” — mere promises. By participating in this game and accepting as collateral claims on other Icelandic banks the central bank was conniving in the banks’ strategy of gambling for resurrection.

Then the banks internationalised the process: the Big Three established subsidiaries in Luxembourg and sold love letters to them. The subsidiaries sold them on to the Central Bank of Luxembourg or the European Central Bank and received cash in return, which they could pass back to the parent bank in Iceland or use themselves. The OECD calculates that just the domestic love letters, between the CBI and the Icelandic banks, incurred losses to the CBI and the Treasury of 13% of GDP (OECD Economic Surveys: Iceland, June 2011).

Financial collapse

The Icelandic banks fell two weeks after Lehman Brothers. On 29 September 2008, Glitnir approached Oddsson at the Central Bank for help with its looming liquidity problem. To restore confidence, Oddsson instructed the Central Bank to buy 75% of Glitnir’s shares. The effect was not to boost Glitnir but to undermine confidence in Iceland. The country’s rating plunged, and credit lines were withdrawn from Landsbanki and Kaupthing. A run on Icesave’s overseas branches began. Oddsson moved on 7 October 2008 to peg the krona to a basket of currencies at close to the pre-crisis value. With the currency tumbling and in the absence of capital controls, the foreign-exchange reserves were exhausted: the peg lasted for only a few hours, just long enough for those in the know to change their money out of the krona at a much more favourable rate. Inside sources indicate that billions left the currency in these hours. Then the krona was floated, and sank. On 8 October the then UK prime minister, Gordon Brown, froze Landsbanki’s UK assets under the anti-terrorism laws. The stock market, bank bonds, house prices and average income went into free-fall.

The IMF arrived in Reykjavik in October 2008 to prepare a crisis-management programme, the first time the Fund had been called in to rescue a developed economy since Britain in 1976. It offered a conditional loan of $2.1bn to stabilise the krona and backed the British and Dutch governments’ demands that Iceland should honour the obligations of the European deposit-guarantee scheme and recompense them for their bailouts of Icesave depositors.

Iceland’s normally placid population erupted in an angry protest movement, principally targeted at Haarde, Oddsson and the IP, although the SDA’s foreign minister Ingibjörg Gísladóttir was considered tarnished too. Thousands of people assembled in Reykjavik’s main square on freezing Saturday afternoons between October 2008 and January 2009, banged saucepans, linked arms in a circle around the parliament building to demand the government’s resignation, and pelted the building with food.

In January 2009, the IP-SDA coalition broke. To date, Iceland is the only country to have shifted distinctly to the left after the financial crisis. An interim SDA-LGM (Social Democrats-Left Green Movement) government was formed in January 2009 to lead until April’s election. In the election the IP was reduced to 16 seats, despite the overwhelming bias of the electoral system in its favour, its worst result since its formation in 1929.

Icesave debt rejected

The SDA-LGM government came under immediate pressure to repay the Icesave debt; much of the IMF loan was withheld until Reykjavik agreed. The new government was also divided on whether to apply for full membership of the EU and Eurozone, with most of the SDA strongly in favour. After long negotiations, the government presented the terms they had agreed on the Icesave debt to the parliament in October 2009: ? 5.5bn ($7.8bn), or 50% of Iceland’s GDP, was to be paid to the British and Dutch treasuries between 2016 and 2023.

The party’s health minister resigned in protest, five dissidents refused to vote with the government. The bill was forced through on 30 December 2009, against high feelings in the country. On 5 January 2010 President Grímsson announced that he would not sign it into law, out of respect for the national sentiment. In the ensuing referendum the bill was decisively rejected. In the May 2010 Reykjavik municipal elections, the SDA slumped to 19% and a comedian was elected as the city’s mayor. In October protests resumed, and the coalition conceded the election of a constitutional assembly to draw up a new constitution (the existing one having been inherited from Denmark on independence in 1944). When the election was invalidated by the Supreme Court, the assembly was reconvened as a constitutional council appointed by parliament.

The deal on the table in this April’s second Icesave referendum involved substantial concessions on the part of the British and Dutch governments. After the no vote, the disagreement may have to go to international courts.

The postponed crisis

The cost of losses on loans and guarantees, added to the cost of restructuring financial organisations, brings the total direct fiscal costs of the crisis to about 20% of GDP, higher than in any other country except Ireland (OECD Economic Surveys, Iceland, June 2011). But the postponement of major public spending cuts until this year has given the economy breathing space; and the sharp devaluation has helped to generate a trade surplus for the first time in many years. So far, Iceland has experienced smaller falls in GDP and employment than big public-spending slashers like Ireland, Estonia and Lithuania. The unemployment rate, only 2% in 2006, has been between 7% and 9% since 2009; but the rate of outmigration, of Icelanders and other European workers (predominantly Polish), has been the highest since 1889. However, the SDA-LGM government has announced drastic cuts in public spending for 2011 and beyond. Local governments have no budget for fresh projects. Hospitals and schools are cutting salaries and sacking employees. The freeze on house repossessions expired in 2010.

Finance in the driving seat

The IP-SDA government’s decision to provide unlimited bank deposit guarantees illustrates its debt to the financial elite. Had it limited the guarantee to 5m krona ($70,000), it would have protected the entire deposits of 95% of depositors; only the wealthiest 5%, including many politicians, benefited from the unlimited guarantee, which now means further constraints on public spending.

Iceland’s tiny scale seemed to make it easier to challenge the government’s denial of the impending crisis, but the opposite was true. The Oddsson government undertook an extreme privatisation of information. Iceland’s National Economic Institute had a reputation for independent thinking, and Oddsson abolished it in 2002. From then on the banks, international rating companies and the Chamber of Commerce provided almost the only information and running commentary on the state of the economy, present and future.

Paradoxically, a number of critical reports were published when the bubble was in the early stages, including one by the CBI. But by 2007-08, when the dangers were acute, reports, including those by the IMF, became noticeably softer in tone. It seems that the official financial institutions, as well as bankers and politicians, understood that the situation was so fragile that just to speak of it might trigger a run on the banks.

In October 2010 the parliament decided to charge Prime Minister Haarde for breach of ministerial responsibility. The permanent finance secretary Baldur Gudlaugsson (former member of the Locomotive group) has been given two years in prison for using inside information for his personal advantage while selling his shares in Landsbanki in September 2008. But the special prosecutor in charge of the investigation of the banks has been working with a team of 60 lawyers and others for the past two years and has so far brought no charges. Meanwhile Oddsson was appointed in September 2009 as editor-in-chief at Morgunblaðið, the leading Iceland daily, and orchestrated coverage of the crisis. A commentator said that was like appointing Nixon editor of The Washington Post after Watergate. Iceland’s elite looks after its own.

This letter makes it perfectly clear that the BLM can not check the validity of a mining claim so long as it has not been withdrawn. Validity of a mining claim does not stop the issuance of the MPO.

Greeks Rush to Gold

On June 21, 2011 the Economic Policy Journal post the following:

In an effort to protect themselves from from the collapse of their banks and government, Greeks are rushing to the only money that governments can't mess with, gold.

Greek citizens are emptying savings accounts and buying gold as they brace themselves for the possibility of a sovereign default and runs on the country’s banks, FT reports.

Sales of gold coins have soared as savers seek a safer and fungible source of value. “When the global financial crisis started, our sales of coins to investors overtook bullion for the first time,” said Harry Krinakis, at Sepheriades, a Greek precious metals trader. “Now the sales ratio has reached five to one.”

Monthly bank withdrawals were running at €1.5bn-€2bn ($2.2bn-$2.9bn) in the first quarter. Last year, depositors withdrew €30bn from Greek banks, equivalent to 12.3 per cent of total savings, according to the Greek central bank.

Take notes, this could be the U.S. down the road.

The Government Attack on Gold

This is a continuation of an article in an earlier post.

On Friday, I detailed how part of the Dodd-Frank Act may ultimately lead to the tracking of gold coins, The Bastards Want to Track Our Gold!. Now comes word that provisions of the Dodd-Frank Act will result in some commodity dealers halting some of their gold trading operations.

It is unclear exactly what in Dodd-Frank is triggering this move by Forex.com. I hope to have more on Monday, but these events should not be viewed in isolation. There is a clear bias in the Dodd-Frank legislation to slow and monitor activity in gold. All holders of gold should be alarmed. I expect more developments along these lines. In my view it is an attempt to gain control over how, when and where gold can be used. There would be too much uproar in the country if gold was confiscated in the manner FDR did in 1933, so this time it needs do be done incrementally, but it sure looks like this is going on.

How long after the Dodd-Frank regulations kick in, before it is discovered that a terrorist cell financed its operations using gold coins and that even more monitoring of gold is going to be required? The stage certainly appears set for further government attacks on gold.
